fa بررسی شروط ناعادلانه و غیر منصفانه در قراردادهای پزشکی و دارویی Investigation of Unfair and Unfair Terms in Medical and Pharmaceutical Contracts پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: احترام به قرارداد‌های خصوصی افراد از اصولی است که در همه کشور‌ها الزامی است، البته باید توجه داشت در برخی از مواقع، قرارداد در شرایط ناعادلانه منعقد شده و یکی از طرفین قرارداد که معمولاً طرف قوی‌تر می‌باشد، اقدام به توافق می‌نماید که عوضین آن با یکدیگر به نحو فاحشی غیر متوازن است و قرارداد حاوی شروط ناعادلانه‌ای را به طرف ضعیف‌تر تحمیل می‌نماید و نمی‌توان نسبت به آن بی‌تفاوت بود، زیرا توازن حین قرارداد عدالت مطلوب است. نمونه بارز آن، قرارداد‌های خرید و فروش داروهای نایاب و یا قرارداد مربوط به اخذ دستمزد گزاف در پزشکی می‌باشد. هدف از این پژوهش بررسی این موضوع در جهت بهبود قوانین و عدالت قراردادی می‌باشد. روش: موضوع تحقیق توصیفی ـ تحلیلی است. پس از مطالعه سوابق پیشین، نظرات و قوانین موجود، داده‌های جمع‌آوری‌شده و به صورت استدلال عقلانی و استنباطی مورد تجزیه و تحلیل قرار می‌گیرند. در این زمینه سعی نموده که از مبانی نظری، تئوری‌های موجود، اصول و ضوابط حاکم استفاده شود. ملاحظات اخلاقی: در پژوهش حاضر اصول اخلاقی ، صداقت و امانتداری رعایت شده است. یافته‌ها: یافته‌ها حاکی از آن است که مقنن باید قوانینی را در جهت ایجاد عدالت قراردادی وضع نماید و یا به گونه‌ای قرارداد‌ها را تفسیر نمود که تا حد امکان از نتیجه ناعادلانه و غیر منصفانه آن کاسته شود. نتیجه‌گیری: قانونگذار لازم است قوانینی کارآمدتری را وضع نماید تا در مواردی که شروط ناعادلانه و غیر منصفانه در قرارداد وضع می‌شود، ضمن رعایت کلیه قواعد حقوقی، آن را تعدیل یا ابطال نکند و عدالت قراردادی را بین طرفین قرارداد برقرار نماید.</div> <div style="text-align: justify;">Background and Aim: Respect in the private profession of individuals is a principle that is mandatory in all countries. Because the balance during the justice contract is desirable. A clear example of this; A contract for the purchase and sale of rare drugs or a contract with a high salary in medicine can be. The purpose of this study is to examine this issue in order to improve law and justice. Method: The subject of the research is descriptive and analytical. After studying the previous records, opinions and existing laws, the data are collected and analyzed in the form of rational and inferential reasoning. In this regard, it has tried to use the theoretical foundations, existing theories, principles and governing criteria. Ethical Considerations: In the present study, ethical principles, honesty and trustworthiness have been observed. Results: The findings indicate that the legislature should enact laws to establish contractual justice or interpret contracts in such a way as to reduce the unfair and unjust outcome as much as possible. Conclusion: The legislator needs to enact more efficient laws to avoid unfair and unfair terms in the contract; While observing all legal rules; Does not modify or annul it and establish contractual justice between the parties to the contract.
