fa بررسی فقهی و حقوقی ایجاد مرگ مغزی به عنوان اعدام در انگاره اثبات Jurisprudential and Legal Study of Brain Death as Execution in the Idea of Proof تخصصي Special پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: آیین‌نامه نحوه اجرای احکام سلب حیات مصوب 1398 فرضیه اهدای عضو زندانیان محکوم به اعدام را به یک چالش فقهی ـ حقوقی ـ اجتماعی تبدیل کرده و باعث واکنش‌های متفاوت سلبی و ایجابی پیرامون این مسأله شده است. تحقیق حاضر مدعی است که با پیش‌گذاردن این شیوه پیشنهادی و ابداعی بسیاری از ضرورت‌های علمی و اجتماعی موجود در این زمینه را پاسخگوست، لذا بر آن شدیم در این‌باره تحقیقی نسبتاً جامع و کاملاً نوین ارائه دهیم و طی آن به سؤالات زیر بر اساس منابع مهم فقهی، حقوقی و به تبع پزشکی پاسخی درخور و حتی‌الامکان راهبردی داده باشیم: 1ـ بررسی جوانب مختلف فرضیه تصویب و تأیید ایجاد مرگ مغزی به ‌عنوان یکی از انواع روش‌های اعدام؛ 2ـ بررسی مبانی معرفت‌‌شناختی، جامعه‌‌شناختی و روان‌شناختی اسلام در مورد جواز یا عدم جواز اهدای عضو زندانی محکوم به ازهاق نفس؛ 3ـ بررسی دیدگاه موافقین و مخالفین حکم اهدا و پیوند عضو زندانیان محکوم به ازهاق نفس از طریق ایجاد مرگ مغزی. روش: این پژوهش به روش توصیفی ـ تحلیلی می‌باشد که با استفاده از منابع کتابخانه‌ای و بر اساس استدلال‌های منطقی و معیارهای معتبر فقهی، حقوقی و پزشکی و بهره‌گیری از ابزار فیش‌برداری تهیه و تدوین گردیده است. ملاحظات اخلاقی: این پژوهش بر پایه اصول اخلاقی و امانتداری نگاشته شده است. یافته‌ها: یافته‌های این پژوهش حاکی از این می‌باشد که با کاوشی ناظر بر استدلال‌ها و استنباط‌های فقهی و حقوقی و مواد قانونی و پیشرفت‌های دانش پزشکی اثبات کردیم که: ایجاد مرگ مغزی به عنوان یکی از انواع اعدام حائز امکان‌های عقلی، علمی، منطقی و آزمایشگاهی می‌باشد، ولی در مورد امکان عملی آن باید رضایت شخص اعدامی و همچنین شرایط محیط ملی و بین‌المللی لحاظ شود. نتیجه‌گیری: با توجه به نتایج و ملاکات مورد نظر شارع در قبال اعدام حدی و قصاص نفس، از جمله نقش زمان و مکان در اعدام یا علن و خفا یا تقدم و تأخر عبرت‌‌آموزبودن یا بخشش، برابری و تناسب جرم (قتل) و جزا (صرف ازهاق نفس)، عدم آزار و اذیت زائد بر حکم و... می‌توان رأی به چنین امکانی با روش‌های صحیح و مورد تأیید جامعه پزشکی به  عنوان یک نوع اعدام که واجد بسیاری از این شرایط می‌باشد، در جهت رفع برخی اما و اگرها و تتمیم ماده قانونی فوق‌الذکر به خدمت گرفت.</div> <div style="text-align: justify;">different negative and positive reactions to this issue. Therefore, we decided to present a relatively comprehensive and completely new research in this regard and during it, to give the appropriate questions based on important jurisprudential, legal and, consequently, medical sources, appropriate and as strategic as possible: 1. Examining the different aspects of the hypothesis of approving and confirming the cause of brain death as one of the types of execution methods; 2. Examining the epistemological, sociological and psychological foundations of Islam regarding the permission or non-permission of donating a prisoner organ sentenced to self-sacrifice; 3. Examining the views of the proponents and opponents of the donation and transplantation of organs of prisoners sentenced to self-immolation through brain death. Method: This descriptive-analytical study has been written to investigate the possibility of brain death with the aim of donating organs to death row inmates, which is done using library resources and based on logical reasoning and analysis and valid jurisprudential, legal and medical criteria. Ethical Considerations: This research is written based on ethical principles and trustworthiness. Results: The findings of this study indicate that; By exploring jurisprudential and legal arguments and inferences and legal materials and advances in medical knowledge, we proved that: brain death as one of the types of execution has intellectual, scientific, logical and laboratory possibilities, but in In case of its practical possibility, the consent of the executed person as well as the conditions of the national and international environment should be considered. Conclusion: According to the results and criteria desired by the Shari'a in relation to partial execution and retribution, including the role of time and place in execution or openly and secretly or precedence and latency of being a lesson, learning or forgiveness, equality and proportionality of crime (murder) and punishment Nafs), no excessive harassment of the sentence, etc. It is possible to vote for such a possibility with the correct and approved methods of the medical community as a type of execution that has many of these conditions in order to eliminate some buts and ifs and completes The above-mentioned legal article came into force.
