fa جبران خسارت ناشی از پژوهش‌های علمی؛ مبانی و ساختارها پژوهشي Original Article <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="font-size:12px;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">زمینه و هدف:</span></span></b> <span lang="AR-SA"><span style="line-height:115%">پژوهش‌های علمی به آن دسته از پژوهش‌هایی اطلاق می‌گردد که بدون قصد درمان </span></span><span lang="FA"><span style="line-height:115%">و با هدف توسعه علوم زیستی یا شناخت آثار محصولات خوراکی و بهداشتی جدید</span></span><span lang="AR-SA"><span style="line-height:115%"> بر روی آزمودنی انسانی انجام می‌گیرد، لذا به دلیل عدم وجود قصد درمان نمی‌توان مسؤولیت مدنی ناشی از آن را با اقدامات درمانی و پزشکی مقایسه کرد. در این پژوهش سعی می‌گردد با تحلیل مبانی و ساختارهای مختلف جبران خسارت ناشی از پژوهش‌های علمی، چالش‌های هر کدام را شناسایی کرده و بهترین ساختار پیشنهاد گردد. </span></span><span dir="LTR" style="line-height:115%"><span style="font-family:"Times New Roman","serif""></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">روش:</span></span></b> <span lang="AR-SA"><span style="line-height:115%">این تحقیق از نوع نظری بوده، ‌روش تحقیق به صورت توصیفی ـ تحلیلی می‌باشد و روش جمع&rlm;آوری اطلاعات به صورت کتابخانه&rlm;ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.<span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA"><span style="line-height:115%">در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.</span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">یافته‌ها:</span></span></b> <span lang="AR-SA"><span style="line-height:115%">در کشورهای پیشرفته برای تشویق شرکت‌کنندگان در پژوهش‌های علمی از پوشش بیمه‌های خاص برای جبران خسارت آزمودنی استفاده می‌گردد و در مواردی که پژوهش‌های علمی توسط مؤسسات دولتی انجام می‌گیرد، خسارت آزمودنی از بودجه پژوهشی همان مؤسسه پرداخت می‌گردد. </span></span><b><span lang="FA"><span style="line-height:115%"><span style="font-family:"B Nazanin""></span></span></span></b></span></span></span><br> <b><span dir="RTL" lang="FA"><span style="line-height:107%">نتیجه‌گیری:</span></span></b> <span dir="RTL" lang="AR-SA"><span style="line-height:107%">در تحلیل‌های صورت‌گرفته روشن گردید که مبانی و نظام‌های سنتی جبران خسارت مانند نظریه تقصیر و نظریه ایجاد خطر در عمل یا باعث عدم جبران کامل خسارت آزمودنی می‌گردد یا ممکن است مانعی برای تحقیقات علمی محسوب گردند، لذا بهتر است از ساختارهای دیگری برای جبران خسارت آزمودنی انسانی در تحقیقات علمی استفاده شود که با توجه به مباحث صورت‌گرفته تضمین پرداخت خسارت آزمودنی از بودجه همان پژوهش در عمل منجر به توسعه تحقیقات علمی می‌گردد و نظام‌های سنتی جبران خسارت کارایی لازم را در جبران خسارت ناشی از پژوهش‌های علمی ندارد.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:115%"><span calibri="" style="font-family:"><b><span style="font-size:12.0pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Background and Aim:</span></span></span></b> <span lang="EN" style="font-size:12.0pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Scientific research refers to those researches that are conducted without the intention of treatment and with the aim of developing biosciences or knowing the effects of new food and health products on human subjects.
