fa اصول مبنایی حقوق بیماران از منظر فقه امامیه در پرتو نظام حقوق بشر بین‌المللی The Basic Principles of Patients' Rights from the Perspective of Imami Jurisprudence in the Light of the International Human Rights System پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: حقوق بیماران یکی از موضوعاتی می‌باشد که از دیرباز در نظام‌های حقوق داخلی و حقوق بشر بین‌المللی مورد توجه نویسندگان قرار گرفته است. هدف از پژوهش حاضر بررسی و تحلیل اصول مبنایی حقوق بیماران از منظر قرآن کریم و روایات ائمه اطهار و نظام حقوق بشر بین‌المللی می‌باشد. روش: این تحقیق از نوع نظری بوده، ‌روش تحقیق به صورت توصیفی ـ تحلیلی می‌باشد و روش جمع &rlm;آوری اطلاعات به صورت کتابخانه&rlm; ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: یافته‌های پژوهش حاضر نشان می‌دهد که اصول مبنایی حقوق بیماران در فقه امامیه، به عنوان یک متغیر مهم در تعیین مصادیق حقوق بیماران کاربرد دارند، اما در فضای حقوق بین‌الملل، اصول بنیادین حقوق بیماران صرفاً دارای یک کارکرد کمکی جهت تشخیص و تفسیر قواعد نمی‌باشند. نتیجه‌گیری: اصول مبنایی حقوق بیماران در فقه امامیه، به عنوان یک متغیر و عامل مهم در تعیین احکام، آثار احکام و به طور کلی تعیین مصادیق حقوق بیماران کاربرد دارند. این اصول به صورت مستقیم و منجز احکام خاصی در ارتباط با حقوق بیماران ارائه نمی‌کنند، اما در فضای حقوق بین‌الملل وضعیت بدین شکل نیست. اصول بنیادین حقوق بیماران نیز در برخی موارد دارای ارتباط نزدیکی با قواعد آمره هستند. به بیان ساده‌تر، برخی از اصول بنیادین حقوق بیماران در فضای نظام حقوق بشر بین‌المللی، مصداق قواعد آمره هستند. قواعد آمره در فضای حقوق بشر بین‌المللی دارای آثار مهمی از جمله «عدول‌ناپذیربودن» می‌باشند. مقصود از عدول‌ناپذیری این است که اصول مزبور در هیچ شرایطی قابلیت تعلیق یا نقض را ندارند.</div> <div style="text-align: justify;">Background and Aim: Patients' rights are one of the topics that have long been considered by authors in domestic law and international human rights systems. The purpose of this research is to examine and analyze the basic principles of patients' rights from the perspective of the Holy Quran and the traditions of the Imams of Athar and the international human rights system. Method: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Results: The findings of the present study show that the basic principles of patients’ rights in Fiqh of Imamiyya are used as an important variable in determining the cases of patients' rights. But in the realm of international law, the fundamental principles of patients' rights do not merely have an auxiliary function of recognizing and interpreting rules. Conclusion: The basic principles of patients’ rights in Fiqh of Imamiyya are used as an important variable and factor in determining the rulings, the effects of the rulings and in general determining the instances of patients' rights. These principles do not directly and explicitly provide specific provisions regarding patients' rights. But this is not the case in international law. The basic principles of patients' rights are in some cases closely related to the peremptory norms. Simply put, some of the fundamental principles of patients' rights in the international human rights system are the peremptory norms. Peremptory norms in the international human rights environment have important implications, including "non-Derogability". non-Derogability means that these principles cannot be suspended or violated under any circumstances.
