fa بررسی فرایند و نظام استفاده از سلول‌های بنیادی و ژن‌درمانی از منظر حقوق ایران Study of the Process and System of Using Stem Cells and Gene Therapy from the Perspective of Iranian Law پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: در سال‌های اخیر پیشرفت‌های بسیار زیادی در عرصه تکنولوژی رخ داده است. یکی از این حوزه‌ها، مسأله سلول‌های بنیادی است. هدف از پژوهش حاضر بررسی و تحلیل مقررات آیین‌نامه‌ای موجود در این حوزه می‌باشد. روش: این تحقیق از نوع نظری بوده، ‌روش تحقیق به صورت توصیفی ـ تحلیلی می‌باشد و روش جمع&rlm;آوری اطلاعات به صورت کتابخانه&rlm;ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: یافته‌های پژوهش حاضر نشان می‌دهد که مسأله استفاده و دسترسی به سلول‌های بنیادی جهت تحقیق و پژوهش مورد توجه واقع نشده است. از طرفی، با توجه به اینکه ژن‌ها و اطلاعات ژنتیکی موجود در آن‌ها، قابلیت اختصاص‌یافتن دارند و نیز ارزش تبادل و خرید و فروش هم دارند، می‌توان آن‌ها را واجد وصف مال دانست، پس از آنجایی که سلول‌های بنیادی، اوصاف خاص مال را با خود دارند، می‌توانند در زمره اموال، قرار گیرند و مالکیت بر آن‌ها نیز می‌تواند از هر حیثی، متفاوت باشد. نتیجه‌گیری: در حقوق داخلی ایران با توجه به خلأهای بسیار زیاد در مقررات آیین‌نامه‌ای موجود، برای جلوگیری از سوءاستفاده‌های احتمالی در این فناوری، بایستی ضمن تدوین مقررات لازم، نسبت به مدیریت و حل تعارض منافع بین عوامل درگیر در این فناوری، اقدام گردد، هرچند در فقدان مصوبات قوی راجع به فرایندهای مرتبط با سلول‌های بنیادی، در نظام کنونی می‌توانیم از نظریه «مسئولیت اعمال منع‌نشده» استفاده نماییم.</div> <div style="text-align: justify;">Background and Aim: In recent years, there have been many developments in the field of technology. One of these areas is the issue of stem cells. The purpose of the current research is to review and analyze the existing regulations in this field. Method: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Results: The findings of the present research show that, the issue of using and accessing stem cells for research has not been considered. On the other hand, considering that the genes and genetic information contained in them have the ability to be assigned and also have the value of exchange and buying and selling, they can be considered property, since stem cells have the special properties of property, they can be classified as property and the ownership of them can be different in any way. Conclusion: In Iran's domestic laws, due to the many gaps in the existing regulations, in order to prevent possible abuses in this technology, while developing the necessary regulations, it is necessary to manage and resolve the conflict of interests between the factors involved in this technology. However, in the absence of strong approvals regarding the processes related to basic cells, in the current system we can use the theory of "responsibility for non-prohibited actions".
