fa مطالعه تطبیقی حقوق باروری مصنوعی در ایران و انگلستان پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">زمینه و هدف:</span></span></b> <span lang="FA"><span style="line-height:115%">باروری مصنوعی به عنوان یکی از روش‌های نوین در علم پزشکی، تغییرات عمده‌ای در شیوه‌های فرزندآوری به وجود آورده است. پژوهش حاضر درصدد است تا حقوق باروری مصنوعی در ایران و انگلستان را بررسی نماید.</span></span><span lang="AR-SA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">روش:</span></span></b> <span lang="FA"><span style="line-height:115%">مطالعه حاضر به شیوه تطبیقی و با بهره‌گیری از روش اسنادی و کتابخانه‌ای صورت گرفته است.</span></span><span lang="AR-SA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">ملاحظات اخلاقی:</span></span></b> <span lang="FA"><span style="line-height:115%">نگارش مقاله حاضر با مبناقراردادن اصول دقیق ارجاع‌دهی و استفاده از منابع فارسی و لاتین معتبر و مرتبط با بحث انجام شده است.</span></span><span lang="AR-SA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">یافته‌ها:</span></span></b> <span lang="FA"><span style="line-height:115%">پذیرش حقوق باروری در فقه و حقوق بر مبنای نگرشی حکمی است و بیشتر دلایل حمایت از آن، مطابقت‌دادن تغییرات زمانه با تحول نهاد خانواده، حمایت از افزایش جمعیت و تلاش برای درمان مشکلات ناباروری است. در انگلیس، باورهای لیبرالی و تأمین رفاه برای همه افراد حتی کودکان متولدشده از باروری مصنوعی مبنا قرار گرفته است.</span></span><b><span lang="FA"><span style="line-height:115%"><span style="font-family:"B Nazanin""></span></span></span></b></span></span></span><br> <b><span dir="RTL" lang="FA"><span style="line-height:107%">نتیجه‌گیری:</span></span></b> <span dir="RTL" lang="FA"><span style="line-height:107%">نظام حقوقی باروری مصنوعی انگلستان در زمینه تأمین منافع عالیه کودکان، نظامی پیشرو است، اما بر عهده‌گرفتن سرپرستان از سوی همجنس‌بازان، تجاری‌شدن بحث باروری مصنوعی از معایب آن هستند. در ایران نیز بر عهده‌گرفتن سرپرستی از سوی زنان مجرد بالای سی سال می‌تواند چالشی برای ازدواج و فرزندآوری محسوب شود.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:14px;"><span style="font-family:Tahoma;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%">Background and Aim:</span></b> <span style="line-height:115%">Artificial insemination as one of the new methods in medical science has caused major changes in childbearing methods. The present study seeks to investigate artificial reproductive rights in Iran and the United Kingdom.</span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%">Method:</span></b> <span style="line-height:115%">The present study is a comparative study using documentary and library methods.</span><span lang="EN"><span style="line-height:115%"><span style="font-family:"Times New Roman","serif""></span></span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span lang="EN"><span style="line-height:115%">Ethical Considerations:</span></span></b> <span style="line-height:115%">The writing of the present article has been done based on the exact principles of citation and the use of valid and relevant Persian and Latin sources.</span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%">Results: </span></b><span style="line-height:115%">Acceptance of reproductive rights in jurisprudence and law is based on a jurisprudential attitude and most of the reasons for supporting it are adapting the changes of time to the evolution of the family institution, supporting population growth and trying to treat infertility problems. In Britain, liberal beliefs and welfare are the basis for all people, even children born of artificial insemination.</span><span style="line-height:115%"><span style="font-family:"Times New Roman","serif""></span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%">Conclusion:</span></b><b> </b><span style="line-height:115%">The UK legal system is a leading system in providing the highest benefits to a child born of fertility and <span style="letter-spacing:-.1pt">custody, but taking on guardians</span> by homosexuals, as well as commercializing artificial insemination, are disadvantages.
