fa مسئولیت مدنی ناشی از اضطرار پزشک Civil Liability Arising from a Doctor's Emergency پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: مسئولیت مدنی پزشک همواره یکی از موضوعات مهم و بحث‌برانگیز در حوزه مسئولیت مدنی بوده است. در این مقاله تلاش شده به این مهم پرداخته شود که مسئولیت مدنی پزشک ناشی از شرایط اضطرار به چه صورت است. روش: مقاله مورد اشاره توصیفی ـ تحلیلی بوده و با استفاده از روش کتابخانه‌ای به بررسی موضوع مورد اشاره پرداخته است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، اصالت متون و امانتداری رعایت شده است. یافته‌ها: مسئولیت مدنی پزشک در شرایط اضطرار تابع نظریه تقصیر می‌باشد، بدین معنی که اگر با رعایت نکات علمی به بیمار زیان وارد نماید مسئولیت ندارد و چنانچه زیان وارده با رعایت اصول پزشکی روی دهد، مسئولیت مدنی پزشک ساقط می‌شود. در موارد فوری و اضطراری اخذ رضایت و برائت از بیمار لازم نیست و اگر پزشک در موارد اضطرار از بیمار یا ولی او رضایت نگیرد، ضامن نیست. نتیجه‌گیری: قانونگذار برائت را از جمله شروط لازم برای مبری‌ساختن پزشک از مسئولیت لازم دانسته است، اما در مواقعی چون اضطرار این اصل کلی نادیده گرفته می‌شود. اگر‌ وضعیت‌ بیمار طوری باشد که فوریت در معالجه را ایجاب نماید، در حالی که وی قادر به اعلام رضایت نباشد و وقت کافی هم وجود نداشته باشد، پزشک در شرایط اضطرار قرار گرفته و لذا فاقد مسئولیت است و این امر از نظر فقها، نه اضطرار، بلکه تابع حکم قاعده احسان است.</div> <div style="text-align: justify;">Background and Aim: Doctor civil liability one of the most important and controversial issues in the field of civil liability has always been. This article to address the important issue of how a doctor's civil liability arises from an emergency tries. Method: This article is Analytical descriptive and uses the library method. Ethical Considerations: In this article, originality of texts, honesty and trusteeship has been complied with. Results: Doctor civil liability in emergency situations is subject to fault theory. This means that if he harms the patient by observing scientific points, he is not responsible and if the damage occurs in accordance with medical principles, the doctor's civil liability will be revoked. In urgent and urgent cases, it is not necessary to obtain the patient's consent and innocence and if the doctor in case of emergency does not obtain the consent of the patient or his guardian, he is not a guarantor. Conclusion: The legislator has considered innocence as one of the necessary conditions to absolve a doctor of responsibility, but in cases such as urgency, this general principle is ignored. If the patient's condition is such that it requires urgent treatment, while he is unable to give consent and there is not enough time, the doctor is in a state of emergency. Therefore, according to the jurists, this is not urgency, but a function of the rule of the rule of benevolence and it has no responsibility.
