style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">زمینه و هدف:</span></b> <span lang="AR-SA">در سال‌های اخیر، شیوع گسترده ویروس کرونا آثار حقوقی، اقتصادی و فرهنگی فراوانی را به همراه داشته است. با توجه به این آثار و پیدایش چالش‌های حقوقی ناشی از آن، پژوهش کنونی با عنوان رویکرد نظام‌های حقوق کیفری به پدیده کرونا به عنوان بیوتروریسم، به بررسی و امکان‌سنجی تعقیب و مجازات عاملان انتشار یا انتقال ویروس کرونا از منظر نظام‌های کیفری داخلی و بین‌المللی پرداخته است.<span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">روش:</span></b> <span lang="AR-SA">مقاله کنونی بر مبنای مطالعات کتابخانه‌ای با استفاده از روش توصیفی ـ تحلیلی و با نگاهی تطبیقی به بررسی رویکرد نظام‌های حقوق کیفری ایران و برخی کشورهای دیگر به پدیده کرونا به عنوان بیوتروریسم پرداخته است.<span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">ملاحظات اخلاقی:</span></b> <span lang="AR-SA">در تمام مراحل تدوین و نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری نیز رعایت شده است.<span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">یافته‌ها:</span></b> <span lang="AR-SA">یافته‌های این پژوهش دلالت بر آن دارد ویروس کرونا قابلیت آن را دارد که به عنوان عامل بیولوژیکی مورد استفاده قرار گیرد و از آن به عنوان ابزاری برای ارتکاب جنایات بین‌المللی استفاده شود. در این صورت از منظر نظام کیفری بین‌المللی، امکان تعقیب و مجازات مرتکب بر اساس شرایط مقرر در اساسنامه دیوان کیفری بین‌المللی </span><span lang="AR-SA">(1998 م.)</span><span lang="AR-SA"> وجود خواهد داشت. با این حال در صورت فقدان شرایط لازم برای تعقیب بین‌المللی مرتکب، باید به نظام‌های کیفری داخلی توسل جست.</span><b><span lang="FA" style="font-family:"B Nazanin""></span></b></span></span></span><br> <b><span dir="RTL" lang="FA"><span style="line-height:107%">نتیجه‌گیری:</span></span></b> <span dir="RTL" lang="AR-SA"><span style="line-height:107%">در برخی نظام‌های کیفری بر اساس قوانین، انتشار و انتقال عمدی ویروس کرونا می‌تواند مصداق بیوترویسم باشد. با این حال در نظام <span style="letter-spacing:-.1pt">کیفری ایران به موجب ماده 286 قانون</span> مجازات اسلامی (1392 ش.)، تنها انتشار کرونا (و نه انتقال)، آن هم در سطح گسترده و با سوءنیت خاص، می‌تواند مصداق بیوتروریسم باشد. این رویکرد قانونگذار، در نظام قضایی ایران، تعقیب و مجازات عاملان انتشار و انتقال ویروس‌های واگیردار کشنده را با محدودیت‌هایی مواجه نموده است؛ به همین جهت، </span></span><span dir="RTL" lang="FA"><span style="line-height:107%">در حال حاضر این اشخاص، عمدتاً در قالب جرائم علیه اشخاص (حسب مورد قتل عمد، غیر عمد و ایراد صدمه بدنی غیر عمدی)، قابل تعقیب و مجازات هستند.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:14px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><b>Background and Aim:</b> <span lang="EN">In recent years, the widespread spread of the corona virus has had many legal, economic and cultural effects.</span> <span lang="EN">As for these effects and the emergence of legal challenges arising from this, the current study entitled The approach of criminal law systems to the corona phenomenon as bioterrorism, based on library studies using a descriptive-analytical method and a comparative look at the possibility Measuring the prosecution and punishment of perpetrators of the spread or transmission of the corona virus from the perspective of the penal system of Iran and several other countries, as well as the international penal system.</span><span style="color:black"></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="background:#f2f2f2">Method:</span></b> <span lang="EN">This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.</span><span lang="EN" style="font-family:"Times New Roman",serif"></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span lang="EN" style="background:#f2f2f2">Ethical Considerations:</span></b> <span lang="EN">In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.</span><span style="font-family:"Times New Roman",serif"></span></span></span><br> <span style="line-height:115%"><b>Results<span style="background:#f2f2f2">:</span></b> <span lang="EN">The findings of this study indicate that the corona virus has the potential to be used as a biological agent and as a tool to commit international crimes</span><span dir="RTL" lang="AR-SA">. </span><span lang="EN">In this case, from the perspective of the international criminal justice system, it will be possible to prosecute and punish the perpetrator in accordance with the provisions of the Statute of the International Criminal Court.</span><span style="color:black"></span></span><br> <span style="line-height:115%"><b>Conclusion:</b><b> </b><span lang="EN">In some criminal systems, according to the law, the intentional spread and transmission of the corona virus can be an example of bioterrorism.
