fa چالش حقوقی ـ پزشکی اصالت و نسبت جنین شبیه‌سازی‌شده Legal Challenge - Medical Authenticity and Proportion of Cloned Embryos پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: امروزه جنین شبیه‌سازی، با سیاست افزایش توالید در جوامع کم جمعیت و یا با تمایل زوجین ناتوان از فرزندآوری به تولید مثل، پدیده‌ای نوظهور است که پیش‌بینی و تدارک راه حل مناسب برای پیامدهای حقوقی ناشی از آن نظیر تعیین انتساب و اصالت جنین شبیه‌سازی‌شده را می‌طلبد. این مسأله آز آن‌سو قابل اهمیت است که تعیین نسب جنین شبیه‌سازی‌شده، مسئولیت‌های مدنی حقوق او همچون ارث و نفقه را مشخص می‌کند. روش: پژوهش حاضر به روش توصیفی ـ تحلیلی می‌کوشد که با بهره‌مندی از داده‌های پزشکی، نظر قواعد حقوقی داخلی و بین‌المللی را در این زمینه بیابد. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: شبیه‌سازی به روش‌های متعددی مانند اهدای جنین، لقاح مصنوعی و کشت‌های ژنتیکی صورت می‌پذیرد که هر یک دارای حکم متفاوتی از نظر حقوقدانان دارد. همچنین از منظر حقوق ایران، از آن جهت که ولایت پدری به کسی واگذار نشده، انتساب جنین به صاحبان سلول به رسمیت شناخته نمی‌شود، در حالی که حقوق بین‌المللی به ویژه در کشورهای اروپایی مانند انگلستان، فرانسه و آلمان، ولایت جنین شبیه‌سازی‌شده را پذیرفته و رسمی نموده است. نتیجه‌گیری: با توجه ‌به ابهام‌ها و اختلاف ‌نظرهای گسترده حقوقی و خلأ قانونی در خصوص قائل‌شدن نسب برای جنین حاصل از شبیه‌سازی و تبیین حقوق مترتب بر آن، به نظر می‌رسد این جنبه‌ مهم، به تبادل‌ نظر و بررسی بیشتر صاحب‌اندیشان و حقوقدانان نیاز داشته باشد.</div> <div style="text-align: justify;">Background and Aim: Today, embryo cloning, with the policy of increasing fertility in low-population societies or with the desire of couples incapable of having children to reproduce, is an emerging phenomenon that requires predicting and preparing an appropriate solution for the legal consequences arising from it; including whether cloning is acceptable in terms of legal rules or not? And assuming acceptance, to whom is the issue of the lineage of the cloned embryo attributed and who is responsible for its rights? Method: The present study uses a descriptive-analytical method to try to find the opinion of domestic and international legal rules in this field by using medical data. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Results: Cloning is carried out by several methods such as embryo donation, artificial insemination and genetic cultures, each of which has a different ruling from the point of view of lawyers. Also, from the perspective of Iranian law, since paternal guardianship has not been assigned to anyone, the attribution of the embryo to the cell owners is not recognized, while international law, especially in European countries such as England, France and Germany, has accepted and formalized the guardianship of the cloned embryo. Conclusion: Given the widespread legal ambiguities and disagreements and the legal vacuum regarding the recognition of lineage for the embryo resulting from cloning and the explanation of the rights arising from it, it seems that this important aspect requires further exchange of views and examination by thinkers and lawyers.
