fa بررسی چالش‌ها و راهکارهای حقوق کیفری ایران در حمایت از بزهکاران و بزه‌دیدگان دارای اختلال روانی: از سیاست‌های تقنینی تا اقدامات اجرایی An Analysis of the Challenges and Solutions of Iranian Criminal Law in Supporting Offenders and Victims with Mental Disorders: From Legislative Policies to Executive Measures پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: تحقیق حاضر به تحلیل چالش‌ها و ارائه راهکارهایی در حوزه حقوق کیفری ایران برای حمایت از بزهکاران و بزه‌دیدگان مبتلا به اختلالات روانی می‌پردازد. با افزایش آگاهی عمومی درباره نقش اختلالات روانی در رفتارهای مجرمانه، نیاز به بازنگری در قوانین و سازوکارهای حقوقی برای تأمین حقوق این افراد بیش از پیش احساس می‌شود. این پژوهش به بررسی چالش‌هایی همچون فقدان ارزیابی‌های تخصصی روانی، کمبود پروتکل‌های مناسب قانونی و نبود سازوکارهای حمایتی برای بزهکاران و بزه‌دیدگان دارای اختلال روانی می‌پردازد. همچنین راهکارهایی مانند تدوین پروتکل‌های تخصصی برای ارزیابی روانی، آموزش مقامات قضایی، ایجاد مراکز درمانی و حمایتی و اعمال سیاست‌های جایگزین کیفر برای بزهکاران ارائه شده است. برای بزه‌دیدگان نیز اقداماتی نظیر بهره‌گیری از ظرفیت عدالت ترمیمی، آموزش و آگاه‌سازی، پیشگیری اجتماعی و وضعی و استفاده از خدمات بزه‌دیده‌شناسی بالینی پیشنهاد شده است. روش: در این پژوهش از روش تحقیقی توصیفی ـ تحلیلی بهره گرفته شده است. ملاحظات اخلاقی: در این پژوهش، اصول اخلاقی شامل رعایت امانتداری علمی، حفظ محرمانگی اطلاعات و احترام به حقوق افراد مورد توجه قرار گرفته است یافته‌ها: یافته‌های پژوهش که مبتنی بر تحلیل کیفی و بررسی اسناد قانونی و روان‌شناسی است، نشان می‌دهد که اصلاحات ساختاری در قوانین کیفری و همکاری مؤثر میان نهادهای قضایی و درمانی می‌تواند بهبود چشم‌گیری در حمایت از این گروه‌ها ایجاد کند. نتیجه‌گیری: کاستی‌های قانونی، نبود مراکز تخصصی و ضعف شناخت قضات از اختلالات روانی، حمایت مؤثر از افراد دارای اختلال روانی را با چالش مواجه نموده، اما با اصلاح قوانین و ایجاد سازوکارهای درمانی می‌توان این وضعیت را بهبود بخشید.</div> Background and Aim: The present study analyzes the challenges and provides solutions in the field of Iranian criminal law to support offenders and victims with mental disorders. With the increase in public awareness about the role of mental disorders in criminal behavior, the need to review laws and legal mechanisms to ensure the rights of these individuals is increasingly felt. This study examines challenges such as the lack of specialized psychological assessments, the lack of appropriate legal protocols and the lack of support mechanisms for offenders and victims with mental disorders. Also, solutions such as developing specialized protocols for psychological assessment, training judicial officials, establishing treatment and support centers and implementing alternative punishment policies for offenders are presented. Measures such as utilizing the capacity of restorative justice, education and awareness, social and situational prevention and the use of clinical victimology services are also proposed for victims. Method: This study employs a descriptive-analytical research method. Ethical Considerations: In this study, ethical principles including academic integrity, confidentiality of information and respect for individuals’ rightshave been observed Results: The research findings, which are based on qualitative analysis and review of legal and psychological documents, indicate that structural reforms in criminal laws and effective cooperation between judicial and treatment institutions can significantly improve the support for these groups. Conclusion:Legal shortcomings, the lack of specialized centers and judges’ limited understanding of mental disorders have posed challenges to effective support for individuals with mental disorders; however, this situation can be improved through legal reforms and the establishment of appropriate therapeutic mechanisms.
