fa واکاوی مبانی حقوقی دادگاه‌های سلامت روان در نظام حقوقی کامن‌لا An Analysis of the Legal Foundations of Mental Health Courts in the Common Law Legal System پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: در بیش از سه دهه گذشته، در برخی کشورهای تابع نظام حقوقی کامن‌لا، برنامه‌های درمانی و اصلاحی در قالب دادگاه‌های سلامت روان به عنوان شیوه‌ای از رسیدگی قضایی نوین، مورد تمسک قرار گرفته است، اما این موضوع که شکل‌گیری برنامه‌های مذکور بر چه مبانی حقوقی استوار می‌باشد، محل پرسش است. همچنین نظر به ضرورت اجرای عدالت در خصوص مخاطبین این برنامه‌ها که از بیماری روانی رنج می‌برند، پژوهش در زمینه ماهیت‌شناسی دادگاه‌های مذکور اهمیت می‌یابد. هدف از نگارش این مقاله، تحلیل مبانی حقوقی این نوع برنامه‌ها است که در قالب دادگاه‌های تخصصی سلامت روان یا در بطن دادگاه‌های سنتی، اما با شیوه‌ای نوین در رسیدگی و واکنش نسبت به جرائم مرتکبین دارای اختلال روانی کمتر از جنون اجرا می‌شود. روش: این مقاله به روش توصیفی و با استفاده از داده‌ها و منابع کتابخانه‌ای صورت گرفته است. ملاحظات اخلاقی: در این روش، اصول اخلاقی و امانتداری علمی رعایت شده است. یافته‌ها: بر پایه یافته‌های این پژوهش، دادگاه‌های سلامت روان بر اساس رویکردهای اصلاحی ـ درمانی و حل مسأله، شکل گرفته‌ و بر مبنای نظریات حقوق درمان‌مدار، عدالت ترمیمی و حقوق پیشگیری، سامان یافته‌اند. نتیجه‌گیری: در نهایت، می‌توان گفت که دادگاه‌های مذکور در نظام حقوقی کامن‌لا، بیشتر بر جنبه درمان محوری قانون، در کنار تجربه عملی در رویه‌های قضایی، استوار می‌باشد. همچنین با واکاوی مبنای حقوقی، فرایند رسیدگی به جرائم ارتکابی، توسط افراد موضوع دادگاه‌های سلامت روان، بر پایه رویکرد «دفاع مسئولیت نقصان یافته» طرح‌ریزی و عملیاتی شده است. <div></div></div> <div style="text-align: justify;">Background and Aim: Over the past three decades, several common law jurisdictions have adopted therapeutic and rehabilitative programs in the form of mental health courts as an innovative approach to judicial adjudication. However, the legal foundations underlying the establishment and operation of these programs remain a matter of inquiry. Given the need to ensure justice for individuals with mental disorders who participate in such programs, examining the legal nature and foundations of mental health courts is of particular importance. This study aims to analyze the legal foundations of these programs, which operate either as specialized mental health courts or within traditional courts through innovative approaches to adjudicating and responding to offenses committed by individuals with mental disorders that do not meet the legal threshold of insanity. Method: This study employs a descriptive research method and draws upon library-based data and documentary sources. Ethical Considerations: Throughout the study, ethical principles and standards of academic integrity were observed. Results: The findings indicate that mental health courts have emerged on the basis of rehabilitative and therapeutic approaches and problem-solving strategies, and are structured around the theoretical frameworks of Therapeutic Jurisprudence, restorative justice, and preventive law. Conclusion: Overall, mental health courts in common law jurisdictions appear to be grounded primarily in the therapeutic orientation of law, complemented by practical experience developed through judicial practice. Furthermore, an examination of their legal foundations indicates that the adjudication of offenses committed by individuals falling within the jurisdiction of mental health courts has been designed and implemented, in part, on the basis of the "diminished responsibility" defense.
