fa حقوق کودکان اوتیسمی در ایران: چالش‌های دسترسی به خدمات و تطبیق با استانداردهای جهانی پژوهشي Original Article <p dir="RTL"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA" style="line-height:115%"><span style="color:maroon">زمینه و هدف:</span></span></b> <span lang="AR-SA" style="line-height:115%">کودکان مبتلا به اختلال طیف اوتیسم (</span><span dir="LTR"><span style="line-height:115%">ASD</span></span><span lang="AR-SA" style="line-height:115%">) در ایران به دلیل نیازهای تخصصی درمانی و آموزشی، از آسیب‌پذیرترین گروه‌های اجتماعی محسوب می‌شوند و در تحقق حقوق بنیادین خود با موانع جدی روبه‌رو هستند. هدف این پژوهش، بررسی شکاف موجود میان قوانین داخلی ایران و استانداردهای جهانی در حمایت از کودکان اوتیسمی و ارائه راهکارهایی برای کاهش این فاصله است.</span><span lang="FA" style="line-height:115%"><span style="font-family:"B Nazanin""></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA" style="line-height:115%"><span style="color:maroon">روش:</span></span></b> <span lang="AR-SA" style="line-height:115%">این مطالعه با رویکرد توصیفی ـ تحلیلی و به روش کتابخانه‌ای انجام شده است. داده‌ها از منابع داخلی، قوانین ملی و اسناد بین‌المللی، از جمله کنوانسیون حقوق کودک (</span><span dir="LTR"><span style="line-height:115%">CRC</span></span><span lang="AR-SA" style="line-height:115%">) و کنوانسیون حقوق افراد دارای معلولیت (</span><span dir="LTR"><span style="line-height:115%">CRPD</span></span><span lang="AR-SA" style="line-height:115%">) گردآوری و به صورت تطبیقی تحلیل شده‌اند.</span><span lang="FA" style="line-height:115%"><span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA" style="line-height:115%"><span style="color:maroon">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA" style="line-height:115%"><span style="color:black">در این تحقیق اصول اخلاق پژوهش از طریق ارجاع‌دهی دقیق به منابع، رعایت حقوق مالکیت فکری نویسندگان و پرهیز از هرگونه سرقت علمی رعایت شده است. تمامی منابع مورد استفاده به ‌طور دقیق ذکر شده و تحلیل و تفسیر مطالب با رعایت صداقت علمی و امانتداری در نقل و استفاده از آثار دیگران صورت گرفته است.</span></span><span lang="FA" style="line-height:115%"><span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA" style="line-height:115%"><span style="color:maroon">یافته‌ها:</span></span></b> <span lang="AR-SA" style="line-height:115%">نتایج نشان می‌دهد که علیرغم وجود قانون حمایت از حقوق افراد دارای معلولیت (مصوب </span><span lang="FA" style="line-height:115%">۱۳۹۶ ش.)</span><span lang="AR-SA" style="line-height:115%">، موانعی چون کمبود بودجه، زیرساخت‌های ناکافی، ناهماهنگی نهادی و نابرابری منطقه‌ای، موجب محدودیت در دسترسی کودکان اوتیسمی به خدمات آموزشی و درمانی شده است. همچنین سطح آگاهی پایین خانواده‌ها و جامعه نسبت به حقوق این کودکان، از چالش‌های اساسی تحقق عدالت اجتماعی در این حوزه است.</span><b><span lang="FA" style="line-height:115%"><span style="font-family:"B Nazanin""></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA" style="line-height:115%"><span style="color:maroon">نتیجه‌گیری:</span></span></b> <span lang="AR-SA" style="line-height:115%">برای تطبیق بهتر نظام حقوقی و اجرایی ایران با استانداردهای بین‌المللی، اصلاح قوانین موجود، ارتقای زیرساخت‌های محلی، آموزش تخصصی نیروی انسانی، تقویت آگاهی عمومی و ایجاد هماهنگی بین نهادهای ذی‌ربط ضروری است. این اقدامات می‌تواند زمینه‌ تحقق مؤثرتر حقوق کودکان اوتیسمی را فراهم آورد.</span></span></span></span></span></span><br> &nbsp;</p> <p style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="color:maroon">Background and Aim:</span></b> Children with Autism Spectrum Disorder (ASD) in Iran, due to their specialized educational and therapeutic needs, represent one of the most vulnerable social groups. This study aims to examine the existing gap between Iran&rsquo;s domestic legal framework and international standards in protecting the rights of autistic children and to propose practical solutions for narrowing this gap<span style="letter-spacing:-.1pt">.</span><span style="font-family:"Times New Roman",serif"></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="color:maroon">Method:</span></b> This research adopts a descriptive-analytical approach using a library-based methodology. Data were collected from national legal sources and international documents, including the Convention on the Rights of the Child (CRC) and the Convention on the Rights of Persons with Disabilities (CRPD) and analyzed through a comparative lens<span style="letter-spacing:-.1pt">.</span><span lang="EN" style="font-family:"Times New Roman",serif"></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span lang="EN"><span style="color:maroon">Ethical Considerations:</span></span></b> Ethical principles in the present research were observed through accurate citation of sources, respect for intellectual property rights and avoidance of plagiarism. All sources used in the study have been properly acknowledged and referenced. The analysis and interpretation of the materials were conducted objectively and honestly, with full respect for academic integrity.</span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="color:maroon">Results:</span></b><b> </b>The findings indicate that despite the enactment of the Law on the Protection of the Rights of Persons with Disabilities (2017), autistic children in Iran face major obstacles in accessing educational and healthcare services. These challenges stem from inadequate funding, insufficient infrastructure, lack of institutional coordination, regional disparities and limited public awareness regarding their rights.</span></span><br> <span style="line-height:115%"><span style="color:black"><b><span style="line-height:115%"><span style="color:maroon">Conclusion:</span></span></b><b> </b><span style="line-height:115%">To bring Iran&rsquo;s legal and practical systems in line with international standards, structural reforms are required. These include legal revisions, development of local infrastructure, enhancement of public awareness, specialized training for service providers and inter-institutional coordination.
