fa بررسی حق بر سلامت در زمان مخاصمات مسلحانه با تأکید بر اقدامات اسرائیل در نوار غزه The Right to Health during Armed Conflicts with Emphasis on Israel's Actions in the Gaza Strip پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: حق بر سلامت به عنوان یکی از بنیادی‌ترین اجزای حقوق بشر، هم در حقوق بین‌الملل بشر و هم در حقوق بین‌الملل بشردوستانه به رسمیت شناخته شده و احترام، حمایت و اجرای آن در هر مکان و زمانی، چه در زمان صلح و چه در زمان مخاصمات مسلحانه برای تمام بازیگران عرصه بین‌المللی ضروری است. کنوانسیون‌ چهارم ژنو در مواد متعددی به حمایت از سلامت غیر نظامیان به‌ خصوص زنان، کودکان و معلولان در زمان جنگ اشاره کرده است. این پژوهش با تمرکز بر اقدامات رژیم صهیونیستی در نوار غزه بعد از تجاوزات رژیم از سال 2023، به بررسی وضعیت حق بر سلامت در این منطقه از منظر حقوق بین‌الملل می‌پردازد. روش: این مطالعه با روش توصیفی ـ تحلیلی و با استفاده از ابزار کتابخانه‌ای، شامل بررسی اسناد بین‌المللی و گزارش‌های موجود، انجام شده است. ملاحظات اخلاقی: در تدوین این مقاله، اصول اخلاقی، از جمله استناد دقیق به منابع و پرهیز از جانبداری غیر منطقی رعایت شده است. یافته‌ها: یافته‌ها نشان می‌دهد که رژیم اسرائیل از ۷ اکتبر ۲۰۲۳، با هدف قراردادن بیمارستان‌ها و مدارس، محاصره نوار غزه و ممانعت از دسترسی شهروندان به نیازهای اساسی مانند غذا، آب و دارو، قواعد حقوق بین‌الملل بشردوستانه را به‌ صورت گسترده نقض کرده است. نتیجه‌گیری: با توجه به یافته‌ها می‌توان ادعا کرد که اسرائیل مرتکب جرایم جنگی، نسل‌کشی و جنایت علیه بشریت شده است. این رفتارها نه‌تنها نقض فاحش حقوق بشر است، بلکه مسئولیت بین‌المللی این رژیم را نیز به دنبال دارد.</div> <div style="text-align: justify;">Background and Aim: The right to health, as one of the most fundamental components of human rights, is recognized under both international human rights law and international humanitarian law. Respecting, protecting and fulfilling this right is essential for all international actors at all times and in all places, whether in peacetime or during armed conflicts. The Fourth Geneva Convention, in numerous articles, refers to the protection of the health of civilians, particularly women, children and persons with disabilities, during war. This research, focusing on the actions of the Zionist regime in the Gaza Strip following its aggression since 2023, examines the status of the right to health in this region from the perspective of international law. Method: This study was conducted using a descriptive-analytical method and library research tools, including the review of international documents and existing reports. Ethical Considerations: In the preparation of this article, ethical principles, including accurate citation of sources and avoidance of unreasonable bias, have been observed. Results: The findings indicate that since October 7, 2023, the Israeli regime has extensively violated the rules of international humanitarian law by targeting hospitals and schools, besieging the Gaza Strip and preventing citizens' access to basic needs such as food, water and medicine. Conclusion: Based on the findings, it can be claimed that Israel has committed war crimes, genocide and crimes against humanity. These actions not only constitute a grave violation of human rights but also entail the international responsibility of this regime.
