fa تحلیل جامع مبانی، چالش‌ها و راهکارهای جبران خسارت ناشی از انتقال خون آلوده پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">زمینه و هدف:</span></span></span></b> <span lang="FA"><span style="line-height:115%">انتقال خون یکی از حیاتی‌ترین مداخلات پزشکی است که در درمان بسیاری از بیماری‌ها نقش کلیدی ایفا می‌کند. با این حال، انتقال خون، علیرغم پیشرفت‌های علمی و نظارتی، همواره با خطر بالقوه انتقال عوامل بیماری‌زا همراه بوده است. مسئولیت مدنی ناشی از انتقال خون آلوده، یکی از پیچیده‌ترین و چالش‌برانگیزترین مباحث حقوقی در حوزه سلامت محسوب می‌شود. بررسی و تحلیل ابعاد مختلف این مسأله، از جمله مبانی نظری و اصول حاکم بر مسئولیت مدنی، چالش‌های موجود در اثبات رابطه سببیت و تعیین میزان خسارت و ارائه راهکارهای جامع برای جبران خسارت زیان‌دیدگان، می‌تواند به بهبود وضعیت حقوقی و حمایتی زیان‌دیدگان انتقال خون آلوده در ایران کمک نماید.</span></span><span lang="AR-SA"><span style="line-height:115%"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">روش: </span></span></span></b><span lang="FA"><span style="line-height:115%">این پژوهش با روش توصیفی ـ تحلیلی و با استفاده از منابع حقوقی داخلی و بین‌المللی، مبانی مسئولیت و چالش‌های ناشی از انتقال خون آلوده را بررسی و راهکارهای جبران خسارت را تبیین می‌نماید. در این راستا، ابتدا مبانی نظری مسئولیت مدنی در این حوزه تحلیل گردیده و سپس انواع تقصیرات احتمالی که می‌تواند منجر به مسئولیت مدنی شود، تشریح خواهد شد. همچنین ارکان تشکیل‌دهنده مسئولیت مدنی در انتقال خون آلوده و نحوه اثبات آن‌ها به تفصیل بررسی می‌شود. علاوه بر این، نظام‌های حقوقی مختلف در مواجهه با این مسئولیت، معرفی و مقایسه می‌شوند.<span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">ملاحظات اخلاقی:</span></span></span></b> <span lang="FA"><span style="line-height:115%">در این پژوهش اصول امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است.<span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">یافته‌ها:</span></span></span></b><span lang="FA"><span style="line-height:115%"> با بررسی ارکان مسئولیت مدنی در انتقال خون آلوده، تحلیل دقیقِ تقصیرات ممکن و نیز تفاوت‌های نظام‌های حقوقی مختلف، می‌توان به نتایج مهمی در این حوزه دست یافت.</span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">نتیجه‌گیری:</span></span></span></b> <span lang="FA"><span style="line-height:115%">با توجه به وضعیت حقوقی ایران، راهکارهایی برای تقویت چهارچوب‌های حقوقی و نظارتی به منظور پیشگیری و جبران خسارات ناشی از انتقال خون آلوده ارائه خواهد شد</span></span><span lang="AR-SA"><span style="line-height:115%">.</span></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Background and Aim:</span></span></b> <span lang="EN"><span style="line-height:115%">Blood transfusion is one of the most vital medical interventions, playing a key role in the treatment of many diseases. However, despite scientific and regulatory advancements, blood transfusion has always been associated with the potential risk of transmitting pathogens. Civil liability arising from contaminated blood transfusion is considered one of the most complex and challenging legal issues in the field of health. Examining and analyzing the various dimensions of this issue, including its theoretical foundations and the governing principles of civil liability, the existing challenges in proving causation and determining the extent of damages and providing comprehensive solutions for compensating injured parties, can help improve the legal and supportive status of victims of contaminated blood transfusion in Iran.</span></span><b><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,serif"></span></span></b></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Method:</span></span></b> <span lang="EN"><span style="line-height:115%">This research, using a descriptive-analytical method and relying on domestic and international legal sources, examines the foundations of liability and the challenges arising from contaminated blood transfusion and elucidates solutions for compensation. In this regard, first, the theoretical foundations of civil liability in this field are analyzed and then the various types of possible faults that can lead to civil liability are explained. Furthermore, the elements constituting civil liability in contaminated blood transfusion and how to prove them are examined in detail.
