Department of Law, Faculty of Humanities Sciences, Maragheh University, Maragheh, Iran. پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: یکی از کاربردهای انرژی هسته‌ای، تولید برق در نیروگاه هسته‌ای می‌باشد. هم‌زمان با تولید برق، می‌توان آب ‌شور دریا را شیرین نمود و به دنبال نمک‌زدایی از آن، نمک تولیدی را به فروش رساند. تحقیقات علمی نشان داده که مصرف آب شیرین‌شده و نمک تولیدی به این روش در درازمدت موجب آسیب به‌ سلامتی مصرف‌کننده خواهد شد. در این پژوهش مسئولیت حقوقی عرضه این اقلام خوراکی مورد مطالعه قرار گرفته است. روش: این پژوهش به روش تحلیلی ـ توصیفی انجام ‌شده و سعی در تشریح مسئولیت حقوقی آسیب به جان شهروندان به سبب مصرف آب شیرین و نمک تولیدی به‌ وسیله انرژی اتمی دارد. ملاحظات اخلاقی: در تمامی مراحل نگارش، مطابق با اصول تحقیق عمل گردید. یافته‌ها: چنین نتیجه شد که به سبب عدم محدودیت قانونی این اقدام، برای مدیران میانی نمی‌توان مسئولیت حقوقی در نظر گرفت. نهادهای نظارتی بخش سلامت تنها موظف به اطلاع‌رسانی موضوع به مقامات ارشد کشور می‌باشند. در مواقع ضرورت، چنانچه این اقدام جزئی از اعمال حاکمیتی دانسته شود، دولت نیز در این خصوص مسئولیتی ندارد. با این حال به سبب اثر منفی بر سلامتی در درازمدت، دولت وظیفه داشته که ضمن تدوین برنامه بلندمدت، نیاز به تولید آب شیرین و نمک را به حداقل برساند. نتیجه‌گیری: در وضعیت اضطراری که به شرایط خشکسالی مربوط است، مصرف آب شیرین تولیدی از انرژی هسته‌ای مسئولیت حقوقی برای مسئولین کشور ایجاد ننموده، لیکن برای مصرف نمک ضرورتی محسوس نیست و در شمول اعمال حاکمیتی قرار ندارد، لذا تجارت این اقلام تولیدی به‌ شرط اطلاع‌رسانی از نحوه تولید و تبعیت خریدار از قوانین کشور متبوع مجاز می‌باشد. دولت وظیفه برنامه‌ریزی با هدف حذف وابستگی بدان را دارد.  </div> <div style="text-align: justify;">Background and Aim: One of the applications of nuclear energy is the production of electricity in a nuclear power plant. At the same time as electricity is produced, it is possible to desalinate seawater and sell the salt produced after desalination. Scientific research has shown that the consumption of desalinated water and salt produced in this way will cause harm to the health of the consumer in the long term. In this study, the legal responsibility of supplying these food items was studied. Method: This study was conducted using an analytical-descriptive method and attempted to explain the legal responsibility for harming the lives of citizens due to the consumption of fresh water and salt produced by nuclear energy. Ethical Considerations: In all stages of writing, the research principles were followed. Results: It was concluded that due to the lack of legal restrictions on this action, middle managers cannot be held legally responsible. Health sector regulatory bodies are only obliged to inform senior officials of the country. In cases of emergency, if this action is considered part of the exercise of sovereignty, the government is not responsible in this regard. However, due to the negative impact on health in the long term, the government has a duty to develop a long-term plan and minimize the need for the production of fresh water and salt. Conclusion: In an emergency situation related to drought conditions, the consumption of fresh water produced from nuclear energy does not create legal responsibility for the country's officials, but there is no tangible necessity for the consumption of salt and it is not included in the exercise of sovereignty. Therefore, the trade of these manufactured items is permitted provided that information is provided about the method of production and the buyer complies with the laws of the respective country.
