fa بررسی شرایط اقاله و تبدیل تعهد در قرارداد مادر جانشین، با نگاهی به عملکرد مشابه در نظام‌های حقوقی مصر و سوریه پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">زمینه و هدف:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">از حدود دو دهه پیش، سازوکار رحم اجاره‌ای به عنوان یکی از روش‌های نوین درمان نازایی معرفی گردید که تنها برخی از نظام‌های حقوقی این سازوکار را به رسمیت شناخته و وضعیت حقوقی آن در بسیاری از کشورها از ابهام رنج می‌برد، لذا اقاله/ تبدیل تعهد این قراردادها محل سؤال می‌باشد</span></span><span lang="AR-SA"><span style="line-height:115%">.</span></span><span dir="LTR"><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,serif"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">روش:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">این پژوهش به روش تحلیلی ـ توصیفی انجام‌ شده و امکان سقط تعهدات مادر جانشین را ضمن قیاس با نظام‌های حقوق مصر و سوریه مورد مطالعه قرار داده است</span></span><span lang="AR-SA"><span style="line-height:115%">.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">ملاحظات اخلاقی:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در تمامی مراحل نگارش، چهارچوب علمی روش تحقیق مد نظر قرار گرفت.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">یافته‌ها:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در کشورهای مصر و سوریه، به تبعیت از پروتکل‌های علمی وزارت بهداشت ایالات ‌متحده آمریکا، برای ده مورد بیماری مادر جانشین که در زمان آزمایش‌های اولیه قابل‌ شناسایی نمی‌باشند، جواز سقوط تعهدات پیش‌بینی ‌شده که در خصوص حقوق مادر جانشین پس از اعمال آن اختلاف ‌نظر وجود دارد. در مواردی که مادر جانشین قصد سوءاستفاده از حقوق خود را داشته باشد، مجازات تعیین ‌شده که قادر به مهار این وضعیت خواهد بود.</span></span><b><span lang="FA"><span style="line-height:115%"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">نتیجه‌گیری:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در کشور ما اصل مادر جانشینی قانونی می‌باشد، اما در خصوص جزئیات اجرایی آن ابهام وجود دارد، لذا اقاله/ تبدیل تعهد مادر جانشین محل سؤال محسوب شده، ولیکن در صورت تأیید وزارت بهداشت بر فقدان خطر جدی برای جنین، مصادیق مشهود آن در مصر و سوریه، در ایران قابل‌ اجرا بوده و فاقد منع قانونی خواهد بود. با این‌ حال ماهیت رومی ـ ژرمنی نظام حقوقی کشورمان شدیداً به وضع قانون جامع در این خصوص نیاز دارد.</span></span></span></span></span></span></span></div> <span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><b><span style="color:maroon">Background and Aim:</span></b> <span lang="EN">In two decades ago, the surrogacy mechanism was introduced as one of the new methods of infertility treatment, which only some legal systems recognized and suffered from legal ambiguity in many countries. Therefore, the termination/ conversion of the obligation of these contracts is questionable</span>.</span><br> <span style="line-height:115%"><b><span style="color:maroon">Method:</span></b> <span lang="EN">This study was doned with analytical-descriptive method and studied the possibility of terminating the obligations of the surrogate mother while comparing them with the legal systems of egypt and syria</span>.</span><br> <span style="line-height:115%"><b><span style="color:maroon">Ethical Considerations:</span></b> In all stages of writing, the principles of research have been considered.</span><br> <span style="line-height:115%"><b><span style="color:maroon">Results:</span></b> <span lang="EN">In Egypt and Syria, in accordance on scientific protocols of the United States Department of Health, for ten cases of surrogate mother diseases that were not identifiable during the initial tests; The permission to fall into the obligations has been foreseen, which is controversial regarding the rights of the surrogate mother after its implementation. In cases where the surrogate mother intends to abuse her rights, a penalty has been determined that will be able to control this situation</span>.</span><br> <span style="line-height:115%"><b><span style="color:maroon">Conclusion:</span></b> <span lang="EN">In our country, the principle of surrogate motherhood is legal. However, there is ambiguity regarding the details of its implementation. Therefore, the cancellation/ conversion of the surrogate mother&#39;s obligation is considered a questionable matter, but if the Ministry of Health confirms the absence of a serious risk to the fetus, its obvious examples in Egypt and Syria, it will be applicable in Iran and will have no legal prohibition.
