fa جایگاه آموزه‌های جرم‌شناسی عصب در تبیین رشد کیفری در قانون مجازات اسلامی پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">زمینه و هدف:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">تحولات اخیر در حوزه علوم اعصاب، زمینه‌ساز شکل‌گیری جرم‌شناسی عصب به عنوان رویکردی میان‌رشته‌ای در تبیین رفتار مجرمانه شده است. این رویکرد با تمرکز بر سازوکارهای عصب‌زیستی مؤثر بر تصمیم‌گیری، کنترل رفتار و ادراک هنجارهای اجتماعی، ظرفیت بازاندیشی در مفاهیم سنتی حقوق کیفری، از جمله رشد کیفری، را فراهم می‌سازد. هدف پژوهش حاضر، بررسی تأثیر آموزه‌های جرم‌شناسی عصب بر تبیین رشد کیفری و تحلیل میزان انطباق مقررات قانون مجازات اسلامی با این آموزه‌هاست</span></span><span lang="AR-SA"><span style="line-height:115%">.</span></span><span dir="LTR"><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,serif"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">روش:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">پژوهش با روش توصیفی ـ تحلیلی و با بهره‌گیری از مطالعات کتابخانه‌ای و منابع علمی مرتبط انجام شده است</span></span><span lang="AR-SA"><span style="line-height:115%">.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">ملاحظات اخلاقی:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در این پژوهش، اصول امانتداری علمی، رعایت حقوق مالکیت فکری، استناد دقیق به منابع و پرهیز از هرگونه تحریف یا انتساب نادرست مطالب رعایت شده است.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">یافته‌ها:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">یافته‌ها نشان می‌دهد رشد کیفری فرایندی تدریجی و چندبعدی است و نمی‌توان آن را صرفاً بر مبنای بلوغ شرعی یا جسمانی احراز کرد. تحلیل ماده ۹۱ قانون مجازات اسلامی نیز نشان می‌دهد مفاهیمی همچون &laquo;درک حرمت و ماهیت رفتار&raquo; و &laquo;شبهه در رشد و کمال عقل&raquo; ظرفیت تفسیر منطبق با یافته‌های جرم‌شناسی عصب و پذیرش امکان عدم رشد کیفری کامل نوجوانان را دارد.</span></span><b><span lang="FA"><span style="line-height:115%"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">نتیجه‌گیری:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">بهره‌گیری از آموزه‌های جرم‌شناسی عصب در تفسیر و اجرای مقررات کیفری می‌تواند زمینه ارزیابی فردمحور رشد کیفری و اتخاذ تصمیمات متناسب‌تر و عادلانه‌تر در قبال نوجوانان را فراهم سازد.</span></span></span></span></span></span></span></div> <h3 data-end="12" data-start="0" style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Background and Aim:</span></span></b><span style="line-height:115%"> Recent developments in neuroscience have contributed to the emergence of neurocriminology as an interdisciplinary approach to explaining criminal behavior. By focusing on neurobiological mechanisms that influence decision-making, behavioral control, and the perception of social norms, this approach provides an opportunity to reconsider traditional concepts of criminal law, including criminal maturity. This study aims to examine the influence of neurocriminological doctrines on the explanation of criminal maturity and to analyze the extent to which the provisions of the Islamic Penal Code are consistent with these doctrines.</span></span><br> <span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Method:</span></span></b><span style="line-height:115%"> This study employs a descriptive-analytical approach and draws upon library-based research and relevant scholarly sources.</span></span><br> <span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Ethical Considerations:</span></span></b><span style="line-height:115%"> Throughout the study, the principles of academic integrity, respect for intellectual property rights, accurate citation of sources, and avoidance of any distortion or misattribution of information were observed.</span></span><br> <span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Results:</span></span></b><span style="line-height:115%"> The findings indicate that criminal maturity is a gradual and multidimensional process and cannot be established solely on the basis of religious or physical maturity. An analysis of Article 91 of the Islamic Penal Code further demonstrates that concepts such as &quot;understanding the prohibition and nature of the conduct&quot; and &quot;doubt regarding the maturity and full development of intellect&quot; have the capacity to be interpreted consistently with the findings of neurocriminology and to accommodate the possibility that adolescents may not have attained full criminal maturity.</span></span><br> <span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Conclusion:</span></span></b><span style="line-height:115%"> Incorporating the insights of neurocriminology into the interpretation and application of criminal law provisions can facilitate an individualized assessment of criminal maturity and contribute to more proportionate and equitable decision-making concerning adolescents.</span><br> <br> <b><span style="line-height:115%">Please cite this article as:</span></b></span><br> <span style="line-height:107%">Keramati Moez H</span><span lang="EN"><span style="line-height:107%">.
