fa چالش‌های اقتصادی و حقوق جنین: یک مرور حیطه‌ای Economic Challenges and Fetal Rights: A Scoping Review پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: حقوق جنین در ایران در بستر تعامل میان مبانی فقهی، قواعد حقوقی و شرایط اجتماعی ـ اقتصادی شکل گرفته است. شواهد نشان می‌دهد که فشارهای اقتصادی می‌توانند از طریق کاهش دسترسی به مراقبت‌های بارداری، تغذیه مناسب و حمایت‌های اجتماعی، تحقق حق حیات و حق سلامت جنین را با چالش مواجه کنند. این مطالعه با هدف شناسایی ابعاد حقوق جنین و بررسی چالش‌های اقتصادی مؤثر بر تحقق آن در ایران انجام شد. روش: این پژوهش به روش مرور حیطه‌ای و بر اساس چهارچوب آرکسی و اومالی انجام شد. جستجوی نظام‌مند مطالعات فارسی و انگلیسی در پایگاه‌های اطلاعاتی معتبر صورت گرفت. پس از غربالگری و ارزیابی، مطالعات مرتبط برای تحلیل نهایی انتخاب شدند. داده‌ها به صورت کیفی و با رویکرد تحلیل محتوا بررسی شدند. ملاحظات اخلاقی: جنبه‌های اخلاقی مطالعات کتابخانه‌ای شامل رعایت اصالت متون، صداقت و امانتداری علمی و استناددهی صحیح به منابع رعایت شده است. یافته‌ها: نتایج نشان داد که حقوق جنین در ادبیات فقهی، حقوقی و سلامت عمدتاً در سه حوزه حقوق پزشکی، حقوق اخلاقی و حقوق اقتصادی/ مدنی دسته‌بندی می‌شود. در این میان، حق حیات و حق سلامت به عنوان حقوق بنیادین جنین شناخته شده‌اند. همچنین چالش‌هایی مانند فقر، هزینه‌های بالای مراقبت‌های بارداری و زایمان، بیکاری، تغذیه ناکافی و نبود حمایت نهادی می‌توانند به تأخیر در مراجعه به خدمات سلامت، افزایش آسیب‌پذیری مادر و در برخی موارد گرایش به سقط جنین منجر شوند. نتیجه‌گیری: یافته‌های این مرور حیطه‌ای نشان می‌دهد که تحقق حقوق جنین صرفاً به قوانین فقهی و حقوقی وابسته نیست، به ‌ویژه از شرایط اقتصادی و میزان دسترسی خانواده‌ها به حمایت‌های اجتماعی و خدمات سلامت تأثیر می‌پذیرد. بنابراین تقویت سیاست‌های حمایتی، عدالت در سلامت و حمایت از مادران باردار می‌تواند در حفظ حقوق جنین مؤثر باشد.  </div> <div style="text-align: justify;">Background and Aim: Fetal rights in Iran are shaped by the interaction of Islamic jurisprudential principles, legal norms, and socio-economic conditions. Evidence suggests that economic pressures may undermine the realization of the fetus’s right to life and right to health by limiting access to prenatal care, adequate nutrition, and social support. This study aims to identify the dimensions of fetal rights and examine the economic challenges affecting their realization in Iran. Method: This study was conducted as a scoping review based on the Arksey and O’Malley framework. A systematic search of Persian- and English-language studies was conducted across major scientific databases. Following the screening and assessment of eligibility, relevant studies were selected for the final analysis. The data were analyzed qualitatively using a content analysis approach. Ethical Considerations: Throughout this scoping review, the principles of academic integrity, honesty, fidelity to the reviewed literature, and proper citation of sources were observed. Results: The findings indicate that fetal rights in the jurisprudential, legal, and health literature can generally be categorized into three domains: medical rights, ethical rights, and economic/civil rights. Among these, the right to life and the right to health are recognized as fundamental rights of the fetus. Furthermore, challenges such as poverty, the high costs of prenatal care and childbirth, unemployment, inadequate nutrition, and insufficient institutional support may contribute to delayed access to healthcare services, increased maternal vulnerability, and, in some cases, a greater propensity toward abortion. Conclusion: The findings of this scoping review indicate that the realization of fetal rights depends not only on jurisprudential and legal frameworks but also, to a considerable extent, on economic conditions and families’ access to social support and healthcare services. Accordingly, strengthening supportive policies, advancing health equity, and enhancing support for pregnant women may contribute significantly to safeguarding fetal rights.
