fa بررسی مبانی فقهی و حقوقی معاملات صوری با رویکردی بر حقوق شهروندی پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:tahoma;">حقوق شهروندی از مباحث مطرح و مهم در جامعه کنونی است که افراد به سبب عضویت در یک دولت ـ ملت در ابعاد حقوق مدنی، سیاسی، اجتماعی و اقتصادی در پرتو دو اصل مهم کرامت انسانی و عدالت اجتماعی از آن برخوردار می‌باشند و از مهم‌ترین حقوق اساسی افراد محسوب می‌شود که رعایت آن به عنوان یکی از شاخصه‌های ثبات امنیت اقتصادی به خصوص در مبحث معاملات ضروری به نظر می‌رسد. امنیت اقتصادی محوری‌ترین موضوع در حقوق شهروندی است که لازمه آن وجود روابط تجاری سالم بین شهروندان و انعقاد معاملات در بستری اطمینان‌بخش است و به سبب آن اموال و دارایی افراد باید از هر گونه تعدی و تجاوز مصون بماند. قانونگذار برقراری امنیت و صحت معاملات را مشروط به قصد انشای واقعی اصحاب قرارداد دانسته است، اما در برخی مواقع افراد به سبب انگیزه‌های مختلف و فرار از محدودیت‌های قانونی، حیثیت و کرامت شهروندان را مورد تعرض قرار داده و اقدام به انعقاد معاملاتی می‌کنند که قصد و اراده واقعی بر انجام آن‌ها وجود ندارد. از مصادیق این‌گونه معاملات، می‌توان به معامله صغیر غیر ممیز، بیهوش، شخص مست، دیوانه و از همه مهم‌تر معاملات صوری به قصد فرار از دین اشاره کرد که یکی از شاخص‌ترین داد و ستدهایی است که از اراده جدی بی‌بهره است. منظور از معامله صوری حالتی است که طرفین ظاهرا وانمود می‌کنند که عقدی را ایجاد نموده‌اند، ولی در واقع پایبند به مفاد آن نمی‌باشند و اراده واقعی در ایجاد رابطه حقوقی وجود ندارد.<br> معاملات صوری در فقه و حقوق ایران به دلیل فقدان قصد انشای واقعی و حمایت از حیات حقوقی شهروندان بالاخص طلبکاران و برقراری امنیت معاملات باطل می‌باشند. به نظر می‌رسد ضعف آگاهی شهروندان در خصوص آثار و تبعات این نوع از معاملات و پایبند نبودن به اخلاقیات و اصول حقوق شهروندی از جمله اصل کرامت، امنیت و عدالت زمینه لازم برای شیوع این معاملات را فراهم می‌سازد. پژوهش حاضر با استفاده از روش‌ کیفی و کتابخانه‌ای به بررسی مبانی فقهی و حقوقی معاملات صوری و نیز ارتباط این معاملات با حقوق شهروندی می‌پردازد.</span></span></div> Citizens&#39; rights is one of the important issues in the current society that That people have it due to membership in a nation-state In terms of civil, political, social and economic rights, In the light of two principles of human dignity and social justice. Economic security is the most important issue in citizens&#39; rights, which requires the existence of healthy business relations between citizens and the Coagulation of transactions in a reassuring place and therefore the property of individuals should be protected from any violation and aggression. The legislator considers the security and accuracy of transactions in related to intention of the actual creation of the contract companions. But in some cases, individuals destroys others Dignity by various motivations And escaping legal constraints and they take action to Coagulations that there is no real intention to do it. From the examples of such transactions, can refer to unconscious child, comatose, mad and Drunk person and, most importantly, formal transaction in order to escape depts. Which is one of the most prominent trades that is devoid of serious will. The formal transaction is a condition in which the sids apparently pretend to have established a contract, but do not actually adhere to its provisions and there is no real intention to establish a legal relationship.<br> The formal transactions in jurisprudence and in Iranian law are False. It is due to the lack of real intention and legal protection of citizens, especially creditors and the securing of void transactions. It seems that the weakness of citizens&#39; awareness about the effects and consequences of this kind of transactions and the non-compliance with the ethics and principles of citizenship rights, including the principle of dignity, security and justice, provide the necessary context for the prevalence of these transactions.
