fa مفهوم و جایگاه حق بر سلامت در اسناد بین‌المللی حقوق بشر <p>با تلاش‌های جامعه بین‌المللی برای حمایت از حقوق بشر، قلمروها و عوامل تأثیرگذاری در تحقق حقوق بشر مورد شناسایی قرار گرفته‌اند. حق برخورداری از بالاترین استانداردهای قابل حصول سلامتی یا حق بر سلامتی یکی از حق‌های بشری است که در اسناد حقوق بشری بر اهمیت آن تأکید شده است. سلامت فردی، به عنوان یکی از مهمترین مولفه‌های کرامت هر انسانی محسوب می‌شود. از این روی حق بر سلامتی به عنوان یکی از حقوق بنیادین بشری در نظام بین‌المللی حقوق بشر به رسمیت شناخته شده است. حوزه‌های مربوط به سلامتی متنوع بوده و دارای ابعاد گوناگونی است و این امر نیز عاملی برای دشواری تعریف حق مزبور شده است. در اسناد حقوق بشری عمدتاً از سلامت جسمی و روانی و بعضاً از سلامت معنوی و اجتماعی حمایت شده است. دولت‌ها نیز به‌طور کلی در ارتباط با تأمین و تضمین این حق دارای مسئولیت‌های معینی می‌باشند. واضح است که دولت‌ها نمی‌توانند به‌طور کامل سلامتی و مطلوب بودن سلامتی افراد را تضمین نمایند اما دولت‌ها می‌توانند شرایطی را فراهم آورند که در آن سلامتی افراد مورد حمایت قرار گیرد و دستیابی به سلامتی برای افراد ممکن گردد. حق بر سلامت جایگاه استواری در اسناد حقوق بشری و عرف بین‌المللی دارد و می‌توان آن را در شمار اصول کلی پذیرفته شده نظام‌های حقوقی توسعه یافته دانست. این حق در شمار حقوق نسل دوم حقوق بشری بر شمرده شده است. در این مقاله به مهمترین جلوه‌های حق بر سلامت در اسناد بین‌المللی حقوق بشر پرداخته شده است. این مقاله درصدد پاسخ دادن به سؤالاتی از قبیل اینکه حق بر سلامتی چه جایگاهی در نظام بین‌المللی حقوق بشر دارد؟ مفهوم محتوایی و عناصر سازنده این حق چیست؟ و انواع تعهد دولت‌ها در قبال این حق چه می‌باشد؟ روش تحقیق استفاده شده در این تحقیق از نوع توصیفی ـ تحلیلی است و ابزار گردآوری داده‌ها و اطلاعات مبتنی بر روش کتابخانه‌ای می‌باشد.</p> <p>With efforts paid by the international community to protect human rights, some area and effective factors in accomplishing human rights have been recognized. Right to highest attainable standards of health that called as the right to health is one of the recognized human rights that its importance has been emphasized on by Human Rights Instruments. Individual health has been counted as one of the most important factors of human dignity. Therefore, rights to health have been recognized as one of the fundamental human rights in international system of human rights. There are different ambits regarding the health each have different dimensions due to which presenting a definition of such rights agreed upon is difficult. Mostly, corporal and mental health and to some extent social and moral health have been protected under the human rights documents. Governments have also generally definite responsibilities upon providing and ensuring such rights. It is clear that governments are not able to provide such circumstances under which preserving health of individuals and its acceptable level can be ensured but they can provide the same to protect the health and its accessibility for individuals. Rights to health have a concrete standing in human right documents and international custom too and can be enumerated among general principles accepted by the developed legal systems. This right is categorized under the second generation of human rights. In this article, the most important aspects of right to health in international human rights documents have been discussed. This article tries to give answers to some questions like what is the standing point of right to health in international legal system. What is contentious concept and elements of such a right? And what are different kinds of obligations levied on governments regarding this right?
