fa جایگاه حقوق اقتصادی ـ اجتماعی در حقوق بشر اسلامی از منظر فقه پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:tahoma;">حقوق بشر دارای ابعاد مختلفی است که در نزد ادیان، مکاتب و ایدئولوژی‌های سیاسی متفاوت دارای تعاریف و تفاسیر گوناگونی است. با این حال، اعلامیه جهانی حقوق بشر که توسط سازمان ملل دنبال می‌شود، به عنوان سند اصلی و قابل اطمینانی میان کشورهای مختلف شناخته می‌شود. حقوق بشر در مفهوم عام و کلی خود به دنبال احقاق حقوق شهروندان فارغ از جنس، نژاد، رنگ، عقاید سیاسی و مذهبی است. از همین رو در حوزه‌های سیاسی، اجتماعی، اقتصادی، فرهنگی و مدنی اهداف و برنامه‌های خاص خود را دنبال می‌کند. از این منظر، فقه به عنوان منشأ قانونگذاری در شریعت اسلامی دارای ظرفیت‌های گسترده‌ای در زمینه حقوق بشر است که حقوق اقتصادی ـ اجتماعی یکی از موضوعات مورد توجه آن است. در این رویکرد، قواعد تعیین‌شده فقهی نه‌تنها مباینی با قواعد عام و کلی حقوق بشر ندارد، بلکه در ابعاد مختلفی، همچون حفظ کرامت انسان، آسایش و رفاه فردی و جمعی، حقوق شهروندان، تأمین آزادی‌های فردی و جمعی و برنامه‌ریزی‌های اجتماعی و اقتصادی شیوه مطلوب‌تری را ارائه می‌دهد. از این رو می‌تواند به عنوان مبنایی برای حقوق بشر اسلامی در نظر گرفته شود. </span></span></div> <div style="text-align: justify;">Human rights have different aspects and definitions in various religions, schools and ideologies. Nonetheless, the Universal Declaration of Human Rights, which is followed by the United Nations, is recognized as the true and official document between different countries. In its ideal sense, human rights seek to uphold the rights of citizens regardless of race, color, beliefs and religion. Thus it pursues its own political, social, economic, cultural and civil goals and programs. From this perspective, jurisprudence as the source of legislation in Islamic law has vast human rights capacities, in which socio-economic rights are of prime importance. In this approach, the established rules of jurisprudence do not contradict the general tenets of human rights, and it provides a more ideal way for fulfilling human rights in a variety of form, such as preserving human dignity, creating individual and collective comfort, maintaining the rights of citizens, providing individual and collective freedoms, and preparing social and economic programs.
