fa آثار اخلاقی نهادهای معافیت از کیفر و تعویق صدور حکم پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:tahoma;"><strong>زمینه و هدف: </strong>فراهم‌کردن شرایط برای بازسازی و احیای مجرمان اجتماعی یکی از موضوعات مهم حقوقی و کیفری در قوانین مختلف دنیا به شمار می‌رود که به نوبه خود بر اخلاق اجتماعی و فردی اثرگذار است. به این دلیل که با اجرای عملیات بازپروری و بازسازی مجرمان اجتماعی و اطمینان از عدم تکرار مجازات، راهی برای اصلاح اخلاقی جامعه فراهم می‌شود. پژوهش حاضر درصدد است تا آثار و پیامدهای اخلاقی نهادهای معافیت از کیفر و تعویق صدور حکم را در حقوق داخلی مورد بررسی قرار دهد.<br> <strong>مواد و روش‌ها: </strong>با توجه به این‌که موضوع بحث، مشروعیت اخلاقی نهادهای معافیت از کیفر و تعویق صدور حکم است، بهره‌گیری از متون حقوقی و اخلاقی و همچنین کندوکاو در قوانین حقوقی و کیفری به عنوان اسناد و منابع این موضوع، در دستور کار قرار گرفته است. بنابراین رویکرد پژوهش، توصیفی ـ تحلیلی و روش پژوهش نیز کیفی است.<br> <strong>یافته‌ها: </strong>مهم‌ترین یافته‌های پژوهش حاضر، این است که نهادهای معافیت از کیفر و تعویق صدور حکم، به دلیل فردی‌کردن مجازات‌ها و همچنین بازپروری مجرمان غیر خطرناک، باعث ایجاد رویه‌های اخلاقی و هنجاری در جامعه اسلامی می‌شوند و از این جهت، اصل کرامت انسانی را در حوزه‌های فردی و اجتماعی، مورد توجه قرار می‌دهند.<br> <strong><span dir="RTL">نتیجه‌گیری: </span></strong><span dir="RTL">بازپروری و اصلاح رفتار انسان در جامعه، یکی از پایه‌های اصلی حقوق و اخلاق اسلامی است و از این جهت، کمک به مجرمان غیر خطرناک، می‌تواند راهی برای احیای آن در جامعه اسلامی باشد، ضمن این‌که نهادهای معافیت از کیفر و تعویق صدور حکم، می‌توانند باعث کاسته‌شدن از تعداد زندانیان و بهبود وضعیت مجرمان اصلاح‌پذیر شود که به نوبه خود مشروعیت اخلاقی دارد. </span></span></span></div> <div style="text-align: justify;"><strong>Background and Purpose</strong>: Providing conditions for the Reconstruction and restoration of social offenders is one of the most important legal and criminal issues in different laws of the world that it in turn effects on social and individual ethics. Because it provides a way to ethically reform for society by conducting Reconstruction and restoration social offenders and ensuring that penalties are not repeated. . The present study seeks to examine the ethical implications and consequences of Institutions exemption from punishment and postponement of the conditional Discharge in domestic law.<br> <strong>materials and methods: </strong>While our subject is Moral legitimacy in of Institutions exemption from punishment And postponement of The conditional Discharge, The use of legal and ethical texts as well as an examination of legal and criminal law as documents and sources on this subject are on the agenda. Therefore, the research approach is descriptive-analytical and the research method is qualitative.<br> <strong>findings: </strong>The most important findings of the present study is that Institutions exemption from punishment And postponement of the conditional Discharge for individualization of penalties as well as the rehabilitation of non-dangerous criminals, create ethical and normative practices in Islamic society, and thus promote the principle of human dignity in the individual and Social.<br> <strong>Conclusion: </strong>Rehabilitation and reform of human behavior in society is one of the main foundations of Islamic law and ethics. So helping to non-dangerous criminals can be a way to revive it in Islamic society.
