fa بررسی تطبیقی قانون حمایت از اطفال و نوجوانان در برابر هرزه‌نگاری و پروتکل الحاقی به کنوانسیون حقوق کودک پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span dir="RTL">هرزه‌نگاری کودک یکی از مصادیق استثمار جنسی علیه این گروه آسیب‌پذیر است که با وجود اسناد بین‌المللی متعدد، از چنان وسعتی برخوردار شده که هیچ نقطه جهان از این معضل ایمن نیست. در سال 2000 پروتکل الحاقی به کنوانسیون حقوق کودک با هدف جرم‌انگاری جهانی هرزه‌نگاری به تصویب قابل توجه کشورهای دنیا مانند ایران رسید. با توجه به آثار این الحاق و همسویی با جامعه جهانی در سال 1399، مجلس، قانون حمایت از اطفال و نوجوانان را تصویب نمود. پژوهش حاضر که با تجزیه و تحلیل داده‌ها با استفاده از ابزار کتابخانه‌ای گردآوری‌شده درصدد پاسخگویی به میزان مطابقت قانون مذکور با پروتکل الحاقی است. با توجه به استمرار دیدگاه دوسویه این قانون نسبت به بزه‌دیدگی و بزه‌کاری هرزه‌نگاری توأم با رضایت نوجوانان، نتیجه، دلالت بر عدم انطباق کامل با هدف پروتکل که خواستار تغییر نگرش دولت‌ها به بزه‌دیدگی مطلق کودکان است، دارد.</span></span></span></div> <div style="text-align: justify;">Child pornography is one of the instances of sexual exploitation against this vulnerable group that, despite numerous international instruments, has become so widespread that no place in the world is safe from this problem. In 2000, the Optional Protocol to the Convention on the Rights of the Child, with the aim of universalizing criminalization of pornography, was ratified by significant countries such as Iran. In light of the effects of this accession and alignment with the international community, the House of Representatives approved the Law on the Protection of Children and Adolescent in 1399. The present study, which analyzes the data collected using the library tool, seeks to answer the question of whether the law is compatible with the Optional Protocol. Given the continuation of the law&#39;s Mutual approach to victimization and criminalization child pornography with adolescent consent, the result implies a complete noncompliance with the protocol that calls for governments to change their attitude toward absolute child victimization.<br> <br> <strong>Please cite this article as:</strong> Nikbakhti J, Mohammad Nasl GH-R, Golpayegani B.
