fa بررسی معیارهای منطقی در تدوین منشور حقوق بیماران <p>در سال‌های اخیر ملاحظات فراوانی در جهت حفظ حقوق بیماران مورد توجه قرار‌گرفته است. مطالعه حقوق بیماران را می‌توان در بازگشت به ارزش‌های بنیادی حقوق انسانی، چون اندیشه‌ی احترام به فرد که حقوق بیماران بر اساس آن بنا نهاده شده است نسبت داد.‌ حقوق بیماران آئینه‌ای از حقوق بشر و حقوق پزشکی است، و مبنایی برای ارتقای سلامت بیماران است. در ایران در قانون مجازات اسلامی به طور پراکنده به حقوق پزشک و بیماران توجه شده است، اما ضرورت تدوین قوانین مدونی که در برگیرنده حقوق بیماران و پزشکان باشد احساس می‌گردد. در سال 1381 منشور ده ماده‌ای حقوق بیماران توسط معاونت سلامت وزارت بهداشت، درمان و آموزش پزشکی تهیه و به مراکز درمانی ابلاغ گردید، این عمل گر‌چه گامی مؤثر در جهت طرح موضوع حقوق بیمار و توجه جامعه به موضوع فوق‌الذکر بود، ولی کافی نیست و در برگیرنده تمامی حقوق یبماران نمی‌باشد. لذا در این مقاله ضمن تعریفی از حقوق بیماران و ذکر منشور حقوق بیماران در رشته‌های درمانی، بیهوشی، دارویی و اعلام اصول کلی، توصیه‌هایی به منظور رعایت حقوق بیماران به پزشکان شده است. و در انتها با بیان نتیجه‌گیری کلی، پیشنهاد شده است با مشارکت علماء فقهی، حقوقدانان با تجربه، پزشکان با سابقه وکارشناسان قضایی، با تلفیق منشورهای اعلام شده و با توجه به اصول کلی حقوق بیماران، نسبت به تهیه و تدوین لایحه جامع حقوق بیماران و تقدیم آن به مجلس جهت تصویب نهایی اقدام گردد.</p> <p>In recent years many considerations have been considered in order to protect the rights of patients. Studying patients&#39; rights can be seen as an observance of the basic values of human rights, such as respect for individuals on which the rights of patients are based. Rights of patients reflect medical rights and human rights, and the basis for improving patients&#39; health.In Iran&#39;s Islamic penal code the doctors&#39; and patients&#39; rights have been recognized, but the necessity of developing laws that involve rights of patients and doctors is obvious. In 1381, the Charter of patients&#39; rights published by Health Department of Ministry of Health and Medical Education to provide health centers was notified. Although this action plan is an effective step for patients and includes legal attention to the subject mentioned above, it is not enough and doesn&rsquo;t comprise all the rights of patients.
