fa مرگ مغزی از منظر حقوق اسلامی <p>تعیین لحظه دقیق مرگ در حقوق از آن‌رو دارای اهمیت فوق‌العاده است که از یک‌سو در حقوق ارثیه و تعیین وارثان مؤثر است و از سوی دیگر در مباحثی از حقوق جزا، اثرگذار اثر مهم‌تری که در دهه‌های اخیر رخ نموده است، تعیین زمان کالبد شکافی اشخاص و استفاده از اعضای آنها برای پیوندهای پزشکی است، چرا که کالبد‌شکافی قبل از مرگ شخص، امکان پذیر نیست. در اعصار ماضی فقه و عرف و پزشکی به توافقی دست یافته بودند که تعیین زمان مرگ چندان مشکل نبود. اما امروزه پدیده خاصی به نام مرگ مغزی مطرح است که تعیین زمان دقیق مرگ در آسیب‌دیدگان منتهی به مرگ مغزی را مشکل نموده است. این مقاله درپی آن است تا ضمن معرفی تفاوت‌های مرگ مغزی و کمای عمیق و زندگی نباتی مستمر، اثبات نماید که همانگونه که از نظر پزشکی مرگ مغزی مصادف با مرگ حقیقی است، چه بسا از منظر حقوق اسلامی نیز بتوان این امر را قبول نمود.</p> <p>To resolve the precise time of death has an extreme importance in law because it is effective in deciding about the inheritance law and in some subdivisions of criminal law.
