fa واکاوی جنبه‌های اخلاقی دستکاری ژنوم انسانی (شبیه‌سازی) در فقه و حقوق کیفری ایران پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span dir="RTL">در سال‌های اخیر پیشرفت‌های فراوانی در حوزه مهندسی ژنتیک و علوم پزشکی رخ داده است. فرآیند شبیه‌سازی یکی از مصادیق مهم پیشرفت‌های مزبور محسوب می‌شود. این مسأله از دو منظر مورد توجه محققان و پژوهشگران قرار گرفته است: یکی استفاده از فرآیند شبیه‌سازی برای درمان بیماری‌ها و دیگری استفاده از این فرآیند برای تولید انسان جدید. برخی از محققان و پژوهشگران حوزه اخلاق، چالش‌هایی را در ارتباط با کارکردهای مختلف عمل شبیه‌سازی مطرح نموده‌اند و به واسطه وجود این چالش‌ها به مخالفت با آن پرداخته‌اند. از آنجا که حوزه اخلاق یکی از مبانی بسیار مهم در فضای حقوق و فقه محسوب می‌شود، در پژوهش حاضر با روشی توصیفی و تحلیلی مشاهده خواهد شد که فرآیند شبیه‌سازی برای درمان بیماری‌ها نه‌تنها با مبانی فقهی و اخلاقی در تعارض یا تزاحم نمی‌باشد، بلکه به جهت نقش بسیار مهمی که در درمان بیماری‌ها دارد مورد تأیید و تأکید قرار گرفته است، اما در ارتباط با کارکرد فرآیند شبیه‌سازی برای تولید یک انسان جدید، چالش‌های اخلاقی و فقهی مهمی مطرح است که موجب مخالفت بسیاری از فقها با فرآیند مزبور شده است. متناظراً در ساحت حقوق کیفری نیز با تکیه بر اصول برائت و توسل به تفسیر مضیق، اساساً عمل شبیه‌سازی با هدف درمانی تا زمانی که مشمول نص صریحی نشود، نمی‌تواند به عنوان جرم تلقی گردد.</span></span></span></div> In recent years, many advances have been made in the field of genetic engineering and medical sciences. The simulation process is one of the important examples of these developments. This issue has been considered by researchers and researchers from two perspectives: one is to use the simulation process to treat diseases and the other is to use this process to produce new humans. Some researchers in the field of ethics have raised challenges related to the various functions of simulation practice and have opposed them due to the existence of these challenges. Since the field of ethics is one of the most important principles in the field of law and jurisprudence, in the present study with a descriptive and analytical method, it will be observed that the simulation process for the treatment of diseases is not only in conflict or conflict with jurisprudential and moral principles, but also Has been confirmed and emphasized for its very important role in the treatment of diseases, but in connection with the function of the simulation process to produce a new human being, there are important moral and jurisprudential challenges that have caused many jurists to oppose this process.
