fa نظارت‌های قوه قضاییه بر سازمان نظام پزشکی به منظور احقاق حقوق سلامت مردم از منظر کارآمدی خدمات Judicial Oversight of The Medical System Organization in Order to Realize the Health Rights of the People From the Perspective of Service Efficiency پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: در این تحقیق نظارت قوهی قضاییه بر سازمان نظام پزشکی، اخلاق عمومی و اخلاق پزشکی مورد بررسی قرار گرفته است و تمام جوانب سلامتی مردم و بیماران از سوی جامعه پزشکی و دست‌اندرکاران امور یهداشتی مطرح شده است. و هدف از تحریر این نوشته بررسی نقش قوه قضائیه بر روی فعالیت‌های سازمان نظام پزشکی به منظور احیا و احقاق حق سلامت عمومی و همچنین تخلفات پزشکی بررسی شده است. مواد و روش‌ها: این پژوهش با استفاده از منابع کتابخانه ای و به شیوه تحلیلی - توصیفی به رشته تحریر درآمده است. یافته‌ها: یافته ها حاکی از این است که گاهی در همین فضا، تخلفاتی به وقوع می‌پیوندد که نیاز به کاوش ژرف است. از آنجا که رسالت علم حقوق و حقوقدانان، حل مسایل حقوقی جامعه، تبیین و تفسیر مواد قانونی و پیشنهاد اصلاح قوانین و مقررات است،  تخلفات پزشکی وقتی اتفاق می‌افتد که پزشک برخلاف قوانین و مقررات رفتار می‌کند. اما جرائم پزشکی زمانی اتفاق می‌افتد که پزشک، در انجام وظایف حرفه‌ای خود، رفتاری را انجام می‌دهد که قانون‌گذار در قانون مجازات اسلامی آن را ممنوع و برای آن مجازات‌هایی تعیین کرده است. ملاحظات اخلاقی: این پژوهش از ابتدا تا انتها با تکیه بر اصول اخلاقی و صداقت و امانتداری نوشته شده است. نتیجه‌گیری: حفظ سلامتی، در طول تاریخ جزء وظایف جامعه پزشکی بوده و وقتی صحبت از حقوق بیماران به میان می‌‌آید منظور، رعایت موازین مربوط از سوی جامعه‌‌ی پزشکی و دست‌اندرکاران امور بهداشتی است. همچنین منظور از اخلاق پزشکی، رعایت اصول اخلاق عمومی و حرفه‌ای توسط شاغلان در امور سلامت می‌‌باشد نکته‌ای که در این پژوهش بدان پرداخته خواهد شد این است که گاهی در همین فضا، تخلفاتی به وقوع می‌پیوندد که نیاز به کاوش ژرف است. از آنجا که رسالت علم حقوق و حقوقدانان، حل مسایل حقوقی جامعه، تبیین و تفسیر مواد قانونی و پیشنهاد اصلاح قوانین و مقررات است، به همین منظور این پژوهش که با هدف بررسی نقش قوه قضائیه بر روی فعالیت‌های سازمان نظام پزشکی به منظور احیا و احقاق حق سلامت عمومی به رشته تحریر درآمده است، بیانگر این نکته است که اساساً تخلفات پزشکی وقتی اتفاق می‌افتد که پزشک برخلاف قوانین و مقررات رفتار می‌کند، مانند سهل‌انگاری در انجام وظیفه یا افشای اسرار بیمار. اما جرائم پزشکی زمانی اتفاق می‌افتد که پزشک، در انجام وظایف حرفه‌ای خود، رفتاری را انجام می‌دهد که قانون‌گذار در قانون مجازات اسلامی آن را ممنوع و برای آن مجازات‌هایی تعیین کرده است.</div> <div style="text-align: justify;">Background and Aim: In this study, the oversight of the judiciary on the organization of the medical system, public ethics and medical ethics has been examined and all aspects of public health are maintained by other medical community and factory workers. The purpose of writing this article is to examine the role of the judiciary in the activities of the medical system organization in order to restore and realize the right to public health as well as such medical violations.   Materials and Methods: This research has been written using library resources and in an analytical-descriptive manner.   Results: But the point to be made in this research is that sometimes in the same space, violations occur that require in-depth exploration, Because the mission of jurisprudence and jurists is to solve the legal problems of society, explain and interpret legal materials and propose amendments to laws and regulations But medical offenses occur when the physician, in performing his or her professional duties, engages in behavior that is prohibited by law in the Islamic Penal Code and imposes penalties for it.   Ethical considerations: In this Research, it has been Written From the Beginning to the End, Relying on Moral Principles, Trustworthiness and Honesty.   Conclusion: Maintaining health has historically been one of the responsibilities of the medical community, and when it comes to patients' rights, it means that the relevant community and medical professionals follow the relevant standards. Medical ethics also means the observance of the principles of general and professional ethics by health professionals. The point that will be addressed in this study is that sometimes in the same space, violations occur that require in-depth investigation. Since the mission of jurisprudence and jurists is to solve the legal problems of society, explain and interpret legal materials and propose amendments to laws and regulations, this study aims to investigate the role of the judiciary in the activities of the medical system in order to revive And the realization of the right to public health has been written, indicating that medical malpractice basically occurs when a physician violates rules and regulations, such as negligence in performing his duties or disclosing patient secrets. But medical crimes occur when a physician, in the performance of his or her professional duties, engages in conduct that is prohibited by the legislature in the Islamic Penal Code and for which penalties are prescribed.
