fa تحولات سیاست جنایی تقنینی جمهوری اسلامی ایران در پیشگیری از بزه‌دیدگی اطفال و نوجوانان پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong>زمینه و هدف: </strong>آزار و خشونت علیه اطفال، از جمله مسائلی است که سابقه‌ای به طول عمر بشریت دارد و در ادوار مختلف تاریخ به طرق متفاوت کودکان را هدف قرار داده است و متأسفانه امروزه نیز به عنوان پدیده‌ای رو به رشد در جوامع به ظاهر متمدن از آن یاد می‌شود. آسیب‌پذیری به دلیل ضعف جسمی، پایین‌بودن سن، متزلزل‌بودن موقعیت اجتماعی از جمله مواردی است که همواره این گروه را در معرض خطر <a href="https://www.yasa.co/prevention-of-child-victimization-by-non-criminal-procedure"><span style="text-decoration:none;text-underline:none;"><span style="color:windowtext;">بزه‌دیدگی</span></span></a> قرار می‌دهد. هدف از انجام این پژوهش بررسی تاریخی قوانین و سیاست جنایی تقنینی جمهوری اسلامی‌ ایران در پیشگیری از بزه‌دیدگی اطفال و نوجوانان و تلاش در جهت حمایت از کودکان کار، بی‌سرپرست و بدسرپرست در جامعه است.<strong><span style="font-size:12.0pt;"></span></strong><br> <strong>مواد و روش‌ها: </strong>این پژوهش به روش توصیفی ـ تحلیلی با استفاده از داده‌های کتابخانه‌ای به بررسی تاریخی قوانین پیشگیری از خشونت علیه کودکان پرداخته است.<br> <strong>یافته‌ها: </strong>یافته‌های پژوهش نشانگر آن است که در طول دهه‌های گذشته قوانین مختلفی در ایران به منظور حمایت از کودکان و پیشگیری از بزه‌دیدگی آن‌ها مصوب شده‌اند که هر ساله نواقص را دارا بوده‌اند.<br> <strong><span dir="RTL">نتیجه‌گیری: </span></strong><span dir="RTL">نتایج تحقیق بیان می‌دارد که با گذشت زمان و بروز موقعیت‌های اجتماعی و فرهنگی جدید قوانین جنایی و تقنینی در جهت پیشگیری بهتر از بزه‌دیدگی کودکان کار، آسیب‌پذیر، بی‌سرپرست و بدسرپرست وضع گردیده‌اند که شامل بهره‌گیری از مددکاران، تغییرات ساختاری در قوانین و رویکرد پلیس ویژه اطفال می‌باشد.</span></span></span></div> <div style="text-align: justify;">Background and Aim: Violence against children is one of the issues that has a long history of humanity and in different periods of history has targeted children in different ways and unfortunately today as a growing phenomenon in societies it is called civilized appearance. Vulnerability due to physical weakness, young age, and shaky social status are some of the things that always put this group at risk of victimization. The purpose of this study is to historically review the laws and legislative criminal policy of the Islamic Republic of Iran in preventing child and adolescent victimization and efforts to support working children, orphans and abused in society.<br> Materials and Methods: This descriptive-analytical study using library data has historically examined the laws of prevention of violence against children.<br> Findings: The research findings indicate that during the past decades, various laws have been passed in Iran to protect children and prevent their victimization, which have shortcomings every year.<span dir="RTL"></span><br> Conclusion: The results of the research show that with the passage of time and the emergence of new social and cultural situations, criminal and legislative laws have been enacted to better prevent the victimization of working, vulnerable, homeless and abused children, including the use of helpers, structural changes.
