fa حقوق و تکالیف زوجین در فقه و حقوق موضوعه با تأکید بر حقوق شهروندی پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong>زمینه و هدف:</strong> زوجین به عنوان اعضایی از شهروندان دارای حقوق و تکالیفی هستند که رعایت آن‌ها تضمین‌کننده حقوق شهروندی در جامعه می‌باشد، پژوهش‌های بی‌شماری در خصوص رعایت حقوق شهروندی زنان صورت گرفته است و جدای از دولت، همسر وی مهم‌ترین شخص در تضمین‌نمودن حقوق شهروندی ایشان می‌باشد و همین امر در خصوص حقوق مردان نیز باید رعایت گردد. در شریعت مقدس اسلام خانواده به عنوان مهم‌ترین رکن جامعه نهادی است مقدس که بر پایه ازدواج سالم و بر مبنای مودت و رحمت شکل می‌گیرد و حقوق و تکالیف و احکام بین زوجین نیز بر همین مبنا شکل می‌پذیرد.<br> <strong>مواد و روش‌ها:</strong> روش کار ما در این تحقیق به صورت توصیفی ـ تحلیلی با استفاده از منابع کتابخانه‌ای می‌باشد.<br> <strong>ملاحظات اخلاقی:</strong> این مقاله با حفظ اصالت محتوا و با رعایت اصل انصاف و امانتداری تدوین شده است.<br> <strong>یافته‌ها:</strong> با ظهور حقوق شهروندی و احترام به حقوق و آزادی‌های شهروندان، حفظ کرامت انسانی و رعایت حقوق هم‌نوعان از حاکمیت به شهروندان و از شهروندان نسبت به همدیگر، به خصوص زوجین تأثیر گذاشت در بازخوانی آیات و روایات و تحلیل ادله در ظروف مختلف با توجه به فهم‌های متفاوتی که از آن می‌شود، می‌تواند برداشت‌های متفاوتی از آن بدهد که سبب صدور احکام متفاوتی در روابط زوجین می‌گردد و این احکام نیز قلمرو حقوق و تکالیف آن‌ها را در قالب حقوق شهروندی مشخص می‌نماید.<br> <strong><span dir="RTL">نتیجه‌گیری:</span></strong><span dir="RTL"> با توجه به این‌که حقوق و تکالیف زوجین شامل دو قسم مشترک و مختص می‌باشد و شارع مقدس برای آن‌ها قواعد و احکامی را وضع نموده است، لیکن برخی از این احکام تحت تأثیر برخی مؤلفه‌ها، مانند احترام به حقوق و آزادی‌های فردی و اجتماعی که تحت عنوان حقوق شهروندی یاد می‌گردد، متحول شده است و از جمله مواردی که قابلیت تغییر را دارند، عبارتند از: تمکین، نفقه، مهریه، اشتغال و خروج از منزل زوجه و... می‌باشد و در مواردی نیز باید اخلاق، عرف و عادات اجتماعی را ملاک عمل قرار داد که در مقاله به آن پرداخته شده است.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> Couples, as members of citizens, have rights and responsibilities that guarantee citizenship rights in society. Numerous studies have been conducted on the observance of women&#39;s citizenship rights and apart from the government, her husband is the most important person in guaranteeing In the holy Shari&#39;a of Islam, the family is the most important element of the holy institutional society, which is formed on the basis of a healthy marriage and on the basis of kindness and mercy and the rights of men. And the duties and rules between couples are formed on the same basis.<span dir="RTL"></span><br> <strong>Materials and Methods:</strong> Our method in this research is descriptive-analytical using library resources.<br> <strong>Ethical Considerations:</strong> In this article, it has been compiled while preserving the originality of the content and observing the principle of fairness and trustworthiness.<br> <strong>Findings:</strong> With the emergence of citizenship rights and respect for the rights and freedoms of citizens, the preservation of human dignity and respect for the rights of fellow human beings from sovereignty to citizens and from citizens to each other, especially couples, affected the reading of verses and hadiths Depending on the different understandings that can be made from it, it can give different interpretations of it, which leads to different rulings in the couple&#39;s relationship; And these rulings also define the scope of their rights and duties in the form of citizenship rights.<br> <strong>Conclusion:</strong> Considering that the rights and duties of couples include two common and specific types and the Holy Shari&#39;a has set rules and rules for them, but some of these rules are influenced by some components, such as respect for individual rights and freedoms.
