fa مقابله با بیوتروریسم بازیگران غیر دولتی با تأکید بر قطع‌نامه 1540 شورای امنیت سازمان ملل متحد Countering Bioterrorism by Non-State Actors with Emphasis on UN Security Council Resolution 1540 پژوهشي Original Article <h3 style="text-align: justify;">زمینه و هدف: بیوتروریسم از سوی بازیگران غیر دولتی خشونت‌طلب یا هویت‌طلب، یک مسأله کاملاً محتمل و قابل توجه در عصر روابط بین‌الملل پساوستفالیایی است که ممکن است به صورت فعال یا غیر فعال تحت حمایت دولت‌ها باشد، اگرچه امروزه تمایل دولت‌های سرکش به کاربرد سلاح‌های بیولوژیکی همچنان نگران‌کننده است، اما موضوع جدیدتر و شاید مهم‌تر، توانایی بازیگران غیر دولتی در توسعه و استفاده از این سلاح‌ها با کمک و یا حتی بدون کمک‌های دولتی است. به دلیل دستیابی آسان‌تر بیوتروریست‌ها به عوامل بیماری‌زا و سلاح‌های بیولوژیکی، خطرات حملات بیوتروریستی از سوی آن‌ها کاملاً قابل پیش‌بینی است که این مسأله چالش و سؤالات زیادی را در حوزه حقوقی ایجاد کرده است. این مقاله با طرح ابهامات موجود در این رابطه، در تلاش است تا واکنش‌های جهانی در مورد این پدیده را بررسی کند، واکنشی که از مهم‌ترین مسؤولیت‌های جامعه جهانی است. در همین راستا، این مقاله به ارزیابی قطع‌نامه 1540 شورای امنیت سازمان ملل متحد، به عنوان یکی از مهم‌ترین سازوکارهای حقوقی بین‌المللی در جهت مقابله با این نوع از بیوتروریسم، پرداخته است. روش: این پژوهش با روش توصیفی ـ تحلیلی تهیه شده و جمع‌آوری اطلاعات آن نیز با ابزار اسنادی ـ کتابخانه‌ای صورت گرفته است. ملاحظات اخلاقی: در تمامی مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: شناسایی عوامل ارتکاب جرائم علیه بشریت، جهت یافتن بهترین تدابیر حفاظتی در مقابل این جرائم از ضرورت بالایی برخوردار است. نتیجه‌گیری: در زمینه بیولوژیکی، ایجاد توازن بین پیشرفت علمی و استفاده مخرب از آن، یکی از چالش‌های بزرگی است که باید به آن واقف بود. تدوین‌کنندگان قطع‌نامه 1540 شورای امنیت، به دنبال تهیه یک توافق بین‌المللی با هدف خنثی‌کردن خطرات امنیتی بازیگران غیر دولتی در سطح جهان بودند. </h3> <div style="text-align: justify;">Background and Aim: Bioterrorism by violent or identity-based non-governmental actors is a very probable and significant issue in the age of post-Austrian international relations that may be actively or passively supported by governments. Although the tendency of rogue states to use biological weapons remains a concern today, a newer and perhaps more important issue is the ability of non-state actors to develop and use these weapons with or without government assistance. Due to the easier access of bioterrorists to pathogens and biological weapons, the risks of bioterrorist attacks by them are quite predictable, which has created many challenges and questions in the legal field. This article tries to examine the global reactions to this phenomenon, which is one of the most important responsibilities of the international community, by raising the existing ambiguities in this regard. In this regard, this article evaluates UN Security Council Resolution 1540 as one of the most important international legal mechanisms to combat this type of bioterrorism. Method: This research has been prepared by descriptive-analytical method and its data collection has been done by documentary-library tools. Ethical Considerations: In all stages of writing the present study, while respecting the originality of the texts, honesty and trustworthiness have been observed. Results: Identifying the perpetrators of crimes against humanity is very necessary to find the best protection measures against these crimes. Conclusion: In the biological field, balancing scientific progress with its destructive use is one of the great challenges to be aware of. The drafters of Security Council Resolution 1540 sought to reach an international agreement aimed at mitigating the security risks of non-state actors worldwide.
