<span lang="FA"><span style="line-height:115%">طیف وسیع تجهیزات پزشکی و گسترش استفاده از آن از یک طرف و روند رو به رشد صدمه و آسیب بر بیماران از سوی دیگر، ضرورت پژوهش در خصوص مسئولیت پزشک و کادر درمان را دوچندان می‌کند؛ مقاله حاضر با هدف تحلیل و واکاوی قانون مجازات اسلامی در مورد مسئولیت کادر درمان در حیطه تجهیزات پزشکی و نشان‌دادن چالش‌های آن در این زمینه نگاشته شده است.</span></span><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">روش:</span></span></b> <span lang="FA"><span style="line-height:115%">پژوهش پیش رو با روش توصیفی ـ تحلیلی و از طریق جمع‌آوری اطلاعات به صورت کتابخانه‌ای و با مراجعه به قوانین و مقالات حقوقی تدوین گردیده است.</span></span><span lang="AR-SA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">ملاحظات اخلاقی:</span></span></b> <span lang="FA"><span style="line-height:115%">در تمام مراحل نگارش مقاله حاضر، ضمن رعایت حقوق دیگران، صداقت و امانتداری نیز رعایت شده style="line-height:115%">یافته‌ها:</span></span></b> <span lang="FA"><span style="line-height:115%">یافته‌ها حاکی از آن است که در ماده 319 قانون مجازات اسلامی مصوب 1370 اصل بر مسئولیت مطلق کادر درمان بود، حال آنکه در ماده 495 قانون مجازات اسلامی مصوب 1392 مسئولیت مبتنی بر تقصیر در نظر گرفته شده است که همین امر مشکلاتی برای اثبات تقصیر کادر درمان در تجویز و به کارگیری تجهیزات پزشکی برای بیماران ایجاد خواهد کرد.</span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">نتیجه‌گیری:</span></span></b> <span lang="FA"><span style="line-height:115%">با تحلیل و ارزیابی قانون مجازات اسلامی جدید مشاهده می‌شود، گرچه قانونگذار ما، موادی در خصوص مسئولیت کادر درمان تصویب کرده است، اما در عمل با چالش‌های جدی، از جمله ضمان بر عهده بیمار و پرستار محروم از دوره‌های تخصصی پزشکی قراردادن و بی‌توجهی به سایر حرف وابسته به پزشکی رو به روست. همچنین با عنایت به قوانین و دستورالعمل‌های اجرایی انگلستان و آمریکا در خصوص تجهیزات پزشکی می‌بایست حق بیمار در مورد آگاهی در هنگام تدوین قوانین مد نظر قرار گیرد.</span></span><span lang="AR-SA"><span equipment and its widespread use, on the one hand, and the growing trend of injury to patients, on the other, redouble the need for research on the responsibility of physicians and medical staff.</span></span> <span lang="EN"><span style="line-height:115%">The present article has been written with the aim of analyzing the Islamic Penal Code on the responsibility of medical staff in the in Article 319 of the Islamic Penal Code adopted in 1991, the principle was the absolute responsibility of the medical staff However, Article 495 of the Islamic Penal Code adopted in 1392 provides for liability based on fault, which will create problems for proving the fault of medical staff in prescribing and using medical equipment for patients</span></span><span style="line-height:115%">.</span><span style="line-height:115%"><span style="font-family:"Times New Roman","serif""></span></span></span></span><br> <b><span style="line-height:107%">Conclusion:</span> </b><span lang="EN"><span style="line-height:107%">Analysis and evaluation of the new Islamic Penal Code shows that although our legislator has approved articles on the responsibility of medical staff, but in practice with serious challenges, including guaranteeing the responsibility of the patient and the nurse deprived of specialized medical courses</span></span> <span lang="EN"><span style="line-height:107%">Facing and ignoring other medical-related words.<b> </b>Also, in accordance with the laws and regulations of the United Kingdom and
