fa بررسی مسؤولیت قراردادی مادر جانشین در برابر والدین ژنتیکی <p>مسؤولیت قراردادی مادرجانشین در برابر والدین ژنتیکی زمانی بوجود می‌آید که یک قرارداد صحیح و الزام‌آوری بین آنها موجود بوده و مادرجانشین تعهدات حاصله را نقض نماید. اکثر این تعهدات، ناشی از توافقات صورت گرفته بین طرفین بوده و سایر منابع ایجاد تعهد اعم از قانون و عرف در این مورد ساکت است. این نقض تعهدات نیز موجب زیان مادی و معنوی والدین ژنتیکی گردیده که می‌بایست جبران شود. طرفین می‌توانند در قرارداد جانشینی در بارداری در مورد جبران خسارت توافق کرده که یا به صورت کاهش در میزان اجرت پرداختی و یا استفاده از محل تضمین مادرجانشین به والدین ژنتیکی ‌باشد. همچنین از آنجا که قرارداد مزبور با حیات یک موجود انسانی در ارتباط است، باید قائل به نامشروع بودن شرط عدم مسؤولیت در آن شد.</p> <p>When the contractual liability of surrogate mother against genetic parents was created that one correct and binding contract concluded between them and surrogate mother violate the created obligation of this contract. Majority of this obligation arises the agreement between them and other resource i.e. law and custom is silent. This violation causes the material and moral damage for genetic parents that must be compensate.
