fa جرم جعل در قانون ثبت اسناد و املاک و ارزیابی رویکرد سیاست جنایی تقنینی ایران در قبال آن پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong><span style="letter-spacing:-.1pt;">زمینه و هدف:</span></strong> جرم &shy;انگاری یکی از ابزارها و مکانیزم&shy; های سیاست جنایی هر کشور در برخورد با بزهکاری و انحرافات اجتماعی می&shy; باشد. در موارد جرائمی که مصادیق زیادی در جامعه دارند، مانند جرم جعل، چنانچه جرم&shy; انگاری بر اساس سیاستی متناسب، معقول، منطقی و مبانی مستحکم صورت نگیرد نه فقط پیامدهای مطلوب نخواهد داشت، بلکه خود سبب ایجاد گرفتاری &shy;ها و معضلات اجتماعی زیادی خواهد گردید.<strong><span style="letter-spacing:-.1pt;"><span style="font-size:10.5pt;"></span></span></strong><br> <strong><span style="letter-spacing:-.1pt;">مواد و روش‌ها:</span></strong> <span style="letter-spacing:-.1pt;">این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می &rlm;باشد و روش جمع &rlm;آوری اطلاعات بصورت کتابخانه &rlm;ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span><strong><span style="letter-spacing:-.1pt;"><span style="font-size:10.5pt;"></span></span></strong><br> <strong><span style="letter-spacing:-.2pt;">یافته‌ها: </span></strong>سیاست جنای تقنینی ایران فرآیند یکسان و یکنواختی ندارد و دچار نوعی بی &shy;نظمی، انحراف و فقدان انسجام می &shy;باشد که این بزرگ&shy;ترین و در عین حال مهم&shy;ترین انتقادی است که می &shy;توان نسبت به این موضوع در ایران عنوان نمود.<span dir="LTR"><span style="font-size:10.5pt;"></span></span><br> <strong><span style="letter-spacing:-.1pt;">ملاحظات اخلاقی:</span></strong> در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت&shy;داری رعایت شده است.<span style="font-size:10.5pt;"></span><br> <strong><span dir="RTL" style="letter-spacing:-.1pt;">نتیجه‌گیری:</span></strong> <span dir="RTL">در مجموع ارزیابی سیاست تقنینی موجود در این حیطه نشان می&shy; دهد که ضابطه&shy; مندی منسجمی در جرم &shy;انگاری جرم جعل وجود ندارد و اهداف و ارزش &shy;های مقنن روشن نیست و علاوه بر این، ابهاماتی در رویکرد سیاست جنایی تقنینی در قبال جرم جعل وجود دارد.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> Criminalization is one of the tools and mechanisms of criminal policy in any country in dealing with crime and social deviations. In the case of crimes that have many instances in society, such as the crime of forgery, if criminalization is not done based on appropriate, reasonable, logical and sound policies, not only will it not have the desired consequences, but it will cause many social problems.<br> <strong>Materials and Methods:</strong> This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.<br> <strong>Results:</strong> Iran&#39;s legislative crime policy does not have a uniform process and suffers from a kind of disorder, deviation and lack of coherence, which is the biggest and at the same time the most important criticism that can be made about this issue in Iran.<br> <strong>Ethical considerations:</strong> In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.<br> <strong>Conclusion</strong>: Overall, the evaluation of the existing legislative policy in this area shows that there is no coherent discipline in the criminalization of forgery and the goals and values of the legislature are not clear.
