fa مبارزه با مواد مخدر در پرتو اسناد بین المللی با تأکید بر سلسله مراتب هنجاری حقوق بین الملل پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong><span style="letter-spacing:-.1pt;">زمینه و هدف:</span></strong> یکی از معضلات اجتماعی جوامع، پدیده جرم و بزهکاری است که در اثر مسائل و مشکلات اجتماعی نظیر فقر، بیکاری، بحران‌های اقتصادی و اجتماعی، دگرگونی در قوانین و الگوهای اجتماعی، تضعیف اعتقادات مذهبی و در کل بر هم خوردن تعادل در نظم اجتماعی پدید می‌آید. در این میان یکی از عوامل و آسیب‌هایی که بزهکاری را به دنبال دارد، مواد مخدر می‌باشد.<strong><span style="letter-spacing:-.1pt;"><span style="font-size:11.0pt;"></span></span></strong><br> <strong><span style="letter-spacing:-.1pt;">مواد و روش‌ها:</span></strong><span style="letter-spacing:-.1pt;"> این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می&rlm; باشد و روش جمع&rlm; آوری اطلاعات بصورت کتابخانه&rlm;ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span><br> <strong><span style="letter-spacing:-.2pt;">یافته‌ها: </span></strong>در ارتباط با تولید و استفاده از مواد مخدر باید به این نکته دقت داشت که استفاده از مواد مزبور، ارتباط بسیار نزدیکی با وضعیت بهداشت و سلامت جامعه بین&shy; المللی دارند. این ویژگی باعث می&shy; شود که در فضای حقوق نیز حساسیت فراوانی نسبت به آن&shy;ها ایجاد شود. تولید و استفاده از مواد مخدر به صورت مستقیم حق بر سلامت را تهدید می&shy; کند. حق بر سلامت نیز به عنوان یکی از مصادیق حق حیات قلمداد می&shy; شود. از طرفی نیز حق حیات یک عنوان کلی در نظام حقوق بشر بین&shy;المللی است که زیرمجموعه حقوق بنیادین بشری قرار می &shy;گیرد.<span dir="LTR"><span style="font-size:11.0pt;"></span></span><br> <strong><span style="letter-spacing:-.1pt;">ملاحظات اخلاقی:</span></strong> در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت&shy;داری رعایت شده است.<span style="letter-spacing:-.1pt;"><span style="color:black;"></span></span><br> <strong><span dir="RTL" style="letter-spacing:-.1pt;">نتیجه‌گیری:</span></strong> <span dir="RTL">تعهدات دولت &shy;ها در زمینه ممنوعیت تولید و استفاده از مواد مخدر به واسطه ارتباط نزدیک با &laquo;حق بر سلامت&raquo; و &laquo;حق حیات&raquo; دارای وصفِ &laquo;آمره&raquo; می&shy; باشند. در نتیجه در فضای حقوق مسئولیت بین&shy; المللی این امکان وجود دارد که الگوی مسئولیت مشدد (یا همان مسئولیت برای نقض قواعد آمره) برای دولت &shy;ها در نظر گرفته شود.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> One of the social problems of societies is the phenomenon of crime and delinquency that arises as a result of social problems such as poverty, unemployment, economic and social crises, changes in laws and social patterns, weakening of religious beliefs and the general imbalance in the social order. Among these, one of the factors and harms that lead to delinquency is drugs.<br> <strong>Materials and Methods:</strong> This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.<br> <strong>Results:</strong> With regard to the production and use of drugs, it should be noted that the use of these drugs is very closely related to the health status of the international community. This feature causes a lot of sensitivity to them in the legal field. The production and use of drugs directly threatens the right to health. The right to health is also considered as one of the examples of the right to life. On the other hand, the right to life is a general title in the international human rights system, which is a subset of fundamental human rights.<br> <strong>Ethical considerations:</strong> In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.<br> <strong>Conclusion</strong>: States&#39; obligation to ban the production and use of narcotics are described as &quot;commanding&quot; because of their close association with the &quot;right to health&quot; and the &quot;right to life.&quot; As a result, in the context of international responsibility law, it is possible for state to adopt a pattern of aggravated responsibility (or responsibility for breach of mandatory rules).<br> <br> <strong>Cite this article as: </strong>Ramazani E, Masoud GH, Shekarchizadeh M.
