fa تأملی در ضرورت ترویج حکمرانی سلامت به مثابه راهکاری میان‌رشته‌ای در مقابله با پاندمی کرونا در پرتو حقوق عمومی سلامت پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">زمینه و هدف:</span></b> <span lang="AR-SA">پاندمی کرونا با همه مشکلات و دشواری‌هایی که برای جامعه جهانی، دولت‌کشورها و آدمیان به وجود آورده است، یک واقعیت را فراروی انسان کنونی قرارداده است. این واقعیت دلالت بر این موضوع می‌نماید که زیست ورای فردی انسان‌ها نقصان‌های جدی دارد. بافت و ساخت زیست انسان ایرانی نیز چنین است. وضعیت اجتماعی، سیاسی، فرهنگی، اقتصادی و... ایرانیان پساظهور کرونا تلاطمات جدی یافته و خلل‌ها خود را نشان داده است. یکی از این خلل‌ها، وضعیت نظام سلامت است که به روشنی هم کاستی‌های خود را نشان داده است و آسیب‌پذیر گردیده است. یکی از مظاهر این کاستی، فقدان حکمرانی سلامت است. نظریه </span><span lang="FA">&laquo;حقوق عمومی سلامت&raquo;</span><span lang="AR-SA"> (که نباید با دانشواژه حقوق سلامت عمومی خلط شود) دیدگاهی فاقد سابقه طرح در ادبیات حقوقی ایران است که می‌تواند مولودی مسعود برای مقابله با پاندمی کرونا به بار آورد. بر بنیان این نظریه باید دیدگاه </span><span lang="FA">&laquo;حقوق عمومی سلامت&raquo; </span><span lang="AR-SA">گسترش یافته، موضوع حکمرانی سلامت را مورد مداقه قرار داده و ترویج دهد تا تمام اجزای نظام حکمرانی در وضعیت پاندمی کرونا در خدمت تأمین سلامت قرار گیرد.<span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">روش:</span></b> <span lang="AR-SA">پژوهش حاضر از نوع پژوهش‌های نظری است که با ‌روش تحقیق توصیفی‌ ـ ‌تحلیلی و رویکرد نوگرا بدون هرگونه سابقه طرح در نظام حقوقی جمهوری اسلامی ایران انجام یافته است. شیوه گرد‌آوری صورت کتابخانه&rlm;ای ـ اینترنتی و با مراجعه به اسناد، کتب و مقالات حقوقی انجام یافته است.</span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">ملاحظات اخلاقی:</span></b> <span lang="FA">در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.</span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">یافته‌ها:</span></b> <span lang="FA">یافته پژوهش دلالت بر ضرورت ارتقای گفتمان حکمرانی سلامت در بستر نظریه جدید </span><span lang="FA">&laquo;حقوق عمومی سلامت&raquo; دارد.</span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">نتیجه‌گیری:</span></b> <span lang="AR-SA">در صورت ترویج گفتمان حکمرانی سلامت در بستر نظریه </span><span lang="FA">&laquo;حقوق عمومی سلامت&raquo;، </span><span lang="AR-SA">بسیاری مصائب مربوط به مدیریت مقابله با کرونا در نظام حقوقی جمهوری اسلامی ایران حل خواهد گردید.</span><span style="font-family:"B Nazanin"" lang="AR-SA"></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="background:#f2f2f2"><span style="line-height:115%"><b><span new="" roman="" style="font-family:" times="">Background and Aim:</span></b><span new="" roman="" style="font-family:" times=""> Aside from the crisis and hardships caused for the international society, nation-states and the individuals, the Covid-19 pandemic has faced the man with the fact that the social life of human being contains serious pitfalls and deficiencies. A fact which stands true for the social life of Iranians as well. The post-Covid social, political, cultural and economical situation of the Iranian society has sustained compelling turbulences and has disclosed several deficiencies. As to one of such deficiencies, one can refer to the health-care system which has clearly proven its flaws and vulnerabilities one of which is the absence of health governance. The public law of health theory (which must be distinguished from the public health law concept) is a theory which has never been raised in the Iranian legal literature and can provide a promising solution for the fight against Covid-19 pandemic. According to the said theory, focus must be had on dissemination of public law of health and heath governance in order for all the organs of the governance system to function toward provision of health care.</span></span></span><br> <span style="background:#f2f2f2"><span style="line-height:115%"><b><span new="" roman="" style="font-family:" times="">Method:</span></b><span new="" roman="" style="font-family:" times=""> the present study is a theoretical study performed with the descriptive-analytical research method and a modern approach.
