fa مسئولیت کیفری ناشی از جراحی‌های نوظهور زیبایی پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong><span style="letter-spacing:-.1pt;">زمینه و هدف</span></strong><span style="letter-spacing:-.1pt;">: </span>سیاست تقنینی کشور ما هنوز در خصوص مشروعیت اعمال جراحی زیبایی متعارف و تبیین و تنسیق قوانین در این گستره که تا کنون برای رفع بدشکلی و یا زیباتر شدن شکل ظاهری بدن انجام می‌گردیده است، مبادرت به اتخاذ تصمیم صحیح ننموده که با چالشی به نام جراحی‌های زیبایی نامتعارف همچون تغییردر رنگ چشم، شکل چشم و گوش، لب و بینی مواجه شده که بر خلاء تقنینی و سیاست اجرایی در این زمینه بیش از پیش افزوده است. هدف اصلی پژوهش حاضر، بررسی مسئولیت کیفری پزشکان جراح و متقاضیان جراحی‌های نوظهور زیبایی و تبیین خلاءهای موجود در این زمینه می&shy; باشد.<em><span style="font-family:B Nazanin;"></span></em><br> <strong><span style="letter-spacing:-.1pt;">مواد و روش‌ها:</span></strong> <span style="letter-spacing:-.1pt;">این پژوهش با روش توصیفی-تحلیلی تهیه شده و جمع&shy; آوری اطلاعات آن نیز با ابزار اسنادی و کتابخانه&shy; ای صورت گرفته است.</span><strong><span style="letter-spacing:-.1pt;"><span style="font-family:B Nazanin;"></span></span></strong><br> <strong><span style="letter-spacing:-.2pt;">یافته‌ها: </span></strong>یافته&shy; ها حکایت از آن دارد که پذیرش مخاطرات، عوارض مهلک و نتایج غیرعقلانی این نوع از جراحی‌ها موازنه ضرورت را به طور کلی برهم زده است به گونه &shy;ای که با ابزار فقهی، حقوقی و اخلاقی دیگر نمی‌توان وجه مشروعیت برای این گونه اعمال قایل شد.<span dir="LTR"></span><br> <strong><span style="letter-spacing:-.1pt;">ملاحظات اخلاقی:</span></strong> در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت&shy;داری رعایت شده است.<span style="letter-spacing:-.1pt;"><span style="font-family:B Nazanin;"></span></span><br> <strong><span dir="RTL" style="letter-spacing:-.1pt;">نتیجه‌گیری:</span></strong> <span dir="RTL">با توجه به عدم وجود قوانین مدون در این راستا از لابه&shy; لای قوانین کیفری و انتظامی حاضر با تفسیرهای مختلف می‌توان برای پزشکان جراح که مبادرت به این&shy;گونه اعمال می‌نمایند بر خلاف متقاضیان آن مسئولیت کیفری قائل گردید و تعیین کیفر نمود. اما این موضوع مهم که با جسم و جان افراد در ارتباط است و فرهنگ جامعه را رو به انحطاط می &shy;برد می‌بایست به قید فوریت توسط مقنن مورد بررسی قرار گرفته و خلاء تقنینی موجود مرتفع گردد و قانون‌گذار به صراحت این&shy;گونه از اعمال جراحی زیبایی را جرم&shy;انگاری نموده و با تنوع منطقی کیفرها با مرتکبان آن برخورد نماید.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> Iran&#39;s legislative policy has not made proper decisions yet regarding the legitimacy of conventional cosmetic surgery, as well as law enforcement and explanation in this area that has been utilized so far to&nbsp;correct&nbsp;defects on the face or&nbsp;body. Increased rates of unusual cosmetic procedures, such as eye color surgery, eye reshaping surgery, otoplasty, lip lift surgery, and rhinoplasty have highlighted the lack of legislative and executive policies in this field The present study aimed to investigate the criminal liability of surgeons and applicants for emerging cosmetic surgeries.<br> <strong>Materials and Methods:</strong> This Research has Been Prepared by Descriptive Analytical Method and its Data has Been Collected by Documentary Librart Tools.<br> <strong>Results:</strong> Accepting the risks<span dir="RTL">,</span> fatal complications, and irrational consequences of these types of surgeries have obviated the necessity of performing these procedures in general so that it is no longer possible to legitimize such acts using jurisprudential, legal, or ethical tools.<br> <strong>Ethical considerations:</strong> In Order to Organize this Research, While Observing the Authenticity of the Texts, Honesty and Fidelity Have Been Observed.<br> <strong>Conclusion</strong>: Regarding the lack of codified laws in this area, criminal liability and punishments can be inflicted on surgeons who perform these acts using the current criminal and disciplinary laws with different interpretations. Considering the necessity of this issue, which is associated with the body and soul of individuals and degrades the culture of society, it must be urgently regarded by the legislators<span dir="RTL">.</span> Following that, the existing legislative gap should be investigated, and the legislators should explicitly criminalize these types of cosmetic procedures, and deal with the perpetrators with a logical variety of punishments and penalties.<br> <br> <strong>Cite this article as: </strong>Fakour H, Sheikholeslami A, Abbasi M.
