fa مصادیق حقوق بشر بین المللی در فرآیند اعمال کیفر حبس با تأکید بر سلسله مراتب هنجاری پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong><span style="letter-spacing:-.1pt;">زمینه و هدف:</span></strong> یکی از مهمترین مسائل در عالم حقوق، مسئله ضمانت اجرای نقض هنجارها می&shy; باشد. به لحاظ تاریخی، یکی از قدیمی&shy;ترین مصادیق ضمانت اجراهای کیفری &laquo;حبس&raquo; می &shy;باشد. در فرآیند اجرای کیفر حبس، مصادیق و استانداردهای مختلفی از حقوق بشر بین &shy;المللی باید مدنظر قرار گیرد.<strong><span style="letter-spacing:-.1pt;"><span style="font-size:11.5pt;"></span></span></strong><br> <strong><span style="letter-spacing:-.1pt;">مواد و روش‌ها:</span></strong> <span style="letter-spacing:-.1pt;">این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می&rlm; باشد و روش جمع &rlm;آوری اطلاعات بصورت کتابخانه &rlm;ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.</span><strong><span style="letter-spacing:-.1pt;"><span style="font-size:11.5pt;"></span></span></strong><br> <strong><span style="letter-spacing:-.2pt;">یافته‌ها: </span></strong>مصادیق حقوق بشر در فرآیند اعمال کیفر حبس در یک طبقه &shy;بندی خاص قرار می گیرند. طبقه اول قواعد بنیادین هستند. این قواعد در واقع جزئی از مصادیق حقوق بنیادین بشر هستند که در ادبیات حقوق بین&shy; الملل موضوعه، مصداقی از قواعد آمره حقوق بین &shy;الملل محسوب می&shy; شوند. طبقه دوم قواعد غیربنیادین هستند. این دسته از قواعد فاقد پیشینه کنوانسیونی یا عرفی می &shy;باشند.<span dir="LTR"><span style="font-size:11.5pt;"></span></span><br> <strong><span style="letter-spacing:-.1pt;">ملاحظات اخلاقی:</span></strong> در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت&shy;داری رعایت شده است.<br> <strong><span dir="RTL" style="letter-spacing:-.1pt;">نتیجه‌گیری:</span></strong> <span dir="RTL">قواعد بنیادین در رأس هرم سلسله مراتب هنجاری حقوق بشر قرار دارند و سایر هنجارها نمی &shy;توانند در تعارض با آنها قرار گیرند. یکی از ویژگی&shy; های این دسته از قواعد، این است که اساساً قواعد مزبور قابل عدول نیستند. به این معنا که هیچ دولتی نمی &shy;تواند به استناد علل و عوامل موجهه و یا رافع مسئولیت این قواعد را اجرا نکند. اما در مقابل قواعد غیربنیادین فاقد چنین وصفی هستند.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> One of the most important issues in the world of law is the issue of guaranteeing the implementation of violations of norms. Historically, one of the oldest examples of bail is &quot;imprisonment&quot;. In the process of imprisonment, various examples and standards of international human rights must be considered.<br> <strong>Materials and Methods:</strong> This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.<br> <strong>Results:</strong> Instances of human rights in the process of punishment of imprisonment are in a special category. The first class is the basic rules. These rules are in fact part of the fundamental human rights examples that are considered in the international law literature in question as examples of the peremptory norms of international law. The second category is non-fundamental rules. These rules have no conventional or customary background.<br> <strong>Ethical considerations:</strong> In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.<br> <strong>Conclusion</strong>: Fundamental rules are at the top of the normative hierarchy of human rights, and other norms cannot be in conflict with them. One of the characteristics of this set of rules is that they are basically irreversible. This means that no government can enforce these rules based on justified or excusable causes and factors.
