fa سیری در مفهوم عدالت در حقوق بین الملل در پرتو منشور ملل متحد A look at the concept of justice in international law in the light of the UN Charter پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: مصنفان منشور ملل متحد به منظور نیل به اهداف و آرمان های مندرج در آن، به عدالت و معادل‌های آن توجه کرده و این سند را به ‌گونه‌ای تصنیف کرده‌اند که ردپای عدالت‌خواهان گیتی را می‌توان در جای‌جای آن مشاهده کرد. به طوری که با بررسی منشور به این نتیجه می توان دست یافت که موازین عدالت و اصول حقوق بین الملل با یکدیگر ملازمه داشته و این امر ضرورت ادامه حیات سازمان و شرط اساسی در نیل به صلح و امنیت بین المللی است. هدف از پژوهش حاضر شرحی بر عدالت در سندی است که تعداد کثیری از همگرایی‌های دولت‌های جهان را متأثر از خود ساخته است. مواد و روش‌ها: این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می&rlm; باشد و روش جمع &rlm;آوری اطلاعات بصورت کتابخانه&rlm; ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافته‌ها: یافته های پژوهش حاضر نشان می دهد که، اقدامات ارکان سازمان در توسعه حقوق بشردوستانه و اهتمام در حل و فصل مسالمت آمیز اختلافات بین المللی از جمله مصادیقی است که رابطه اساسی بین مفهوم عدالت و توسعه تدریجی حقوق بین الملل را آشکار ساخته است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. نتیجه‌گیری: هرچند در عمل و در قالب برخی اقدامات ارکان ملل متحد از منظر آرمان‌گرایانه، نقض اصول عدالت را می‌توان به وضوح مشاهده کرد. اما نگاه واقع‌گرایانه و توجه به توسعه تدریجی حقوق بین‌الملل و الزامات آن در هزاره سوم، عدالت به عنوان ضرورت روابط بین‌الملل به شمار نیامده و این نگاه، حق بر عدالت را به ذهن متبادر می‌سازد نه عدالت به مثابه حق.</div> <div style="text-align: justify;">Background and Aim: The authors of the UN Charter, in order to achieve the goals and ideals contained in it, have paid attention to justice and its equations, and have drafted this document in such a way that the traces of the justice seekers of the universe can be seen in its place. Thus, by examining the Charter, it can be concluded that the standards of justice and the principles of international law are interrelated, and this is a necessity for the continuation of the life of the organization and a basic condition for achieving international peace and security. The purpose of this study is to describe justice in a document that has affected a large number of convergences of world governments. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Results: The findings of the present study show that the actions of the pillars of the organization in the development of humanitarian rights and efforts in the peaceful settlement of international disputes are among the examples that have revealed the fundamental relationship between the concept of justice and the gradual development of international law. Ethical considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Conclusion: However, in practice and in the form of some actions of the United Nations pillars from an idealistic point of view, the violation of the principles of justice can be clearly seen. But a realistic view and attention to the gradual development of international law and its requirements in the third millennium, justice is not considered a necessity of international relations, and this view brings to mind the right to justice, not justice as a right.
