fa بررسی مبانی حقوق شهروندی در نظام قضایی ایران پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">زمینه و هدف:</span></b> <span lang="AR-SA">حقوق شهروندی جزئی از مفاهیم معاصر است که وارد ادبیات حقوقی ایران هم شده است. همچنین در ساختار قضایی ایران رویکردی مثبت نسبت به این مفهوم وجود دارد و کوشش بر این است تا این مفهوم به طور عملی مورد استفاده قرار گیرد. هدف ما در این مقاله شناخت مبانی حقوق شهروندی در نظام حقوقی ایران می‌باشد.<span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">روش:</span></b> <span lang="FA">مقاله حاضر به شیوه توصیفی ـ تحلیلی مبانی حقوق شهروندی در نظام قضایی ایران را مورد بررسی قرار داده و در تبیین این مبانی کوشش نموده است. ابزار تحقیق فیش‌برداری از منابع کتابخانه‌ای می‌باشد.</span><span lang="AR-SA"><span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">ملاحظات اخلاقی:</span></b> <span lang="AR-SA">از ابتدا تا انتهای مقاله اصول صداقت و امانتداری رعایت گردیده است.</span><span lang="FA"><span style="color:black"></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA">یافته‌ها:</span></b> <span lang="AR-SA">یافته‌ها حاکی از این است که در حقوق شهروندی در تمام ساحت‌های جامعه ایران نیز به ‌عنوان مفهومی مثبت پذیرفته ‌شده و متمح نظر آحاد افراد جامعه نیز می‌باشد. اهمیت این موضوع و ضرورت پرداختن به آن در متون علمی در حال انتشار امری بدیهی است و محققانی در سراسر دنیا به دنبال بهبود فهم جوامع از حقوقی هستند که در مواجهه با ساختار قضایی لازم و ضروری است.</span><b><span style="font-family:"B Nazanin"" lang="FA"></span></b></span></span></span><br> <b><span dir="RTL" lang="FA"><span style="line-height:107%">نتیجه‌گیری:</span></span></b> <span dir="RTL" lang="AR-SA"><span style="line-height:107%">بهره‌مندی از اصل برائت، حق دفاع، دادرسی عادلانه، حق اعتراض به تصمیمات قضایی، رسیدگی علنی و بدون تبعیض، حق دسترسی به ادله قضایی، اصل قانونی‌بودن جرائم و مجازات‌ها، حق جبران خسارات ناشی از اشتباهات قضایی، حق انتخاب وکیل از مهم‌ترین حقوق قضایی شهروندی محسوب می‌گردد. در حقوق ایران در اصل 34 قانون اساسی، دادخواهی حق مسلم تمامی افراد ذکر شده است. طبق اصل 156، قوه</span></span> <span dir="RTL" lang="AR-SA"><span style="line-height:107%">قضاییه پشتیبان حقوق فردی و اجتماعی و مسئول تحقق‌بخشیدن به عدالت و نیز احیای حقوق عامه و گسترش عدل و آزادی‌های مشروع قرار داده ‌شده است.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%">Background and Aim:</span></b> <span style="line-height:115%">Citizenship rights are a part of contemporary concepts that have entered the legal literature of Iran. Also, in Iran&#39;s judicial structure, there is a positive approach towards this concept, and efforts are being made to use this concept practically. In Iranian law, in Article 34 of the Constitution, litigation is an inalienable right of all people.
