نقد رویکرد طرح مالکیت صنعتی در خصوص استثنای کاربرد درمانی جدید از حیطه اختراعات قابل ثبت با استفاده از حقوق تطبیقی و تأکید بر آثار اقتصادی

<div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">زمینه و هدف:</span></span></b><span lang="FA"><span style="line-height:115%"> شناسایی کاربرد درمانی جدید که در صنعت داروسازی با عنوان هدفگذاری مجدد دارو نیز شناخته میشود، فرآیندی است که به موجب آن کاربرد درمانی جدیدی برای داروهای موجود شناسایی میشود. با توجه به مزایایی که این فرآیند نسبت به شناسایی ماهیت شیمیایی جدید دارد بسیاری از شرکتهای داروسازی تمرکز خود را بر استفاده از این راهبرد معطوف کردهاند. در اسناد بینالمللی و منطقهای رویکرد واحدی وجود ندارد، به طوری که برخی اسناد حکمی در این خصوص نداشته، برخی قائل به حمایت و برخی اقدام به استثنای این قبیل اختراعات کردهاند. رویکرد قانونگذار ایران در شرایط کنونی به نحوی است که علیرغم سکوت قانون ثبت اختراعات، طرحهای صنعتی و علائم تجاری ۱۳۸۶ میتوان این دسته از اختراعات را، با مد نظر قراردادن مواد ۲ و ۴ این قانون، قابل حمایت تلقی کرد. با این حال، یکی از مواردی که به موجب بند دوم ماده ۴ طرح حمایت از مالکیت صنعتی از حیطه حمایت از اختراع استثنا شده است، کاربرد جدید از فرآوردهها یا فرآیندهای شناخته شده میباشد، لذا در این مقاله ضمن بررسی رویکرد اسناد بینالمللی و قوانین کشورها، مزیتهای هدفگذاری مجدد دارو از منظر اقتصادی و آثار نامطلوب احتمالی مورد بررسی و تجزیه و تحلیل قرار گرفته تا از این طریق بتوان رویکرد تقنینی ایران در این خصوص را به بسته به مورد، تأیید یا مورد انتقاد قرار داد.</span></span></span></span></span><br>
<span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">روش:</span></span></b><b> </b><span lang="FA"><span style="line-height:115%">این مقاله به صورت تحلیلی ـ تطبیقی میباشد و با روش کتابخانهای، با بهرهگیری از ابزار فیشبرداری تهیه و تدوین گردیده است.</span></span><span lang="FA"><span style="color:black"></span></span></span></span></span><br>
<span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">ملاحظات اخلاقی:</span></span></b><span lang="FA"><span style="line-height:115%"> در تمامی مراحل نگارش مقاله حاضر، اصول اخلاقی پژوهش، به ویژه اصالت متن، صداقت، رازداری و امانتداری رعایت شده است.</span></span></span></span></span><br>
<span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">یافتهها:</span></span></b><span lang="FA"><span style="line-height:115%"> یافتهها حاکی از این است که یکی از دلایل ابرازی در خصوص عدم حمایت از این دسته از اختراعات، آثار اقتصادی نامطلوبی است که ممکن است بر فعالیت ژنریکسازان و افزایش قیمت دارو در بازار رخ دهد، به نحوی که ورود این شرکتها به بازار با موانع جدی مواجه شده یا دشوار شود و در نتیجه قیمت دارو افزایش یابد.</span></span></span></span></span><br>
<b><span dir="RTL" lang="FA"><span style="line-height:107%">نتیجهگیری:</span></span></b><span dir="RTL" lang="FA"><span style="line-height:107%"> بررسیهای انجامیافته نشان میدهد رویکرد برخی از کشورها و اسناد بینالمللی در مخالفت با موضوع، بدون توجه به ماهیت و محدوده حمایتی این نوع اختراعات، مزایای اقتصادی آن نسبت به توسعه ماهیت شیمیایی جدید، نهاد برچسبگذاری ناقص و در نتیجه عدم اخلال در فعالیت ژنریکسازان و افزایش قیمت دارو است.</span></span></span></span></div>
<div style="text-align: justify;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="font-size:9.5pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Background and Aim:</span></span></span></b><span style="font-size:9.5pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times=""> Identifying new therapeutic uses that known as Drug Repurposing in the pharmaceutical industry, is a process by which new medical indications for existing drugs are identified. Given the benefits of this process compared to identification and development of a new chemical entity, many pharmaceutical companies have focused on this strategy. There is no single approach in international and regional instruments, so that some of them do not have a rule in this regard, some have considered these inventions as patentable subject-matters and some other have excluded them from patentability. Despite the silence of the Iranian Patent, Industrial Design and Trademark Law of 2007 concerning patentability of new therapeutic uses, such inventions could be considered as patentable based on the Article 2 and 4 of this law. However, one of the exclusions from patentable subject-matter under Article 4 (2) of the new Industrial Property Protection Parliamentary Plan relates to the new use of known products or processes. This paper seeks to review and compare the approaches adopted by international instruments, national laws and the advantages and impacts of drug repurposing from an economic point of view. </span></span></span><span style="font-size:9.5pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times=""><span style="color:#70ad47"></span></span></span></span></span></span><br>
<span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="font-size:9.5pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Method:</span></span></span></b><span style="font-size:9.5pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times=""> The research method is Analytical-Comparative. It has been prepared and compiled by library method using Note-taking techniques.</span></span></span><span lang="EN" style="font-size:9.5pt"><span style="line-height:115%"><span style="font-family:"Times New Roman","serif""></span></span></span></span></span><br>
<span style="background:#f7f7f7"><span style="line-height:115%"><b><span lang="EN" style="font-size:9.5pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Ethical Considerations:</span></span></span></b> <span style="font-size:9.5pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">In all stages of writing this paper, the ethical principles of research, especially, the originality of the text, honesty and confidentiality have been fully observed.</span></span></span></span></span><br>
<span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="font-size:9.5pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Results:</span></span></span></b><b> </b><span style="font-size:9.5pt"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">The findings indicate that one of the reasons for lack of legal protection for these inventions is the adverse economic effects that may occur on the activities of generic drug makers and raising drug prices in the market, so that the entry of these companies into the market face serious obstacles and increase subsequently drug prices.</span></span></span></span></span><br>
<b><span style="font-size:9.5pt"><span style="line-height:107%"><span new="" roman="" style="font-family:" times="">Conclusion:</span></span></span> </b><span style="font-size:9.5pt"><span style="line-height:107%"><span new="" roman="" style="font-family:" times="">Some legal approaches to exclusion of new therapeutic uses from patentable subject-matter are resulted from lack of enough attention to the nature and scope of protection of such inventions, their economic benefits compared to developing new chemical entity, skinny labeling and therefore lack of disrupting effects on the generic drug makers and lack of increase in drug prices.</span></span></span><br>
