fa موانع توسعه حقوق عمومی با تاکید بر موانع آموزشی پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><strong><span style="letter-spacing:-.1pt;">زمینه و هدف:</span></strong> اساس حقوق را می &shy;بایست در حقوق عمومی جست&shy;وجو کرد. چرا که اساسا &laquo;نظام حقوقی&raquo; و هر &laquo;نظم حقوقی&raquo; در ساحت اقتدار سیاسی معنا یافته و مفهوم &laquo;ضمانت اجرا&raquo; به عنوان مرز بین هنجارهای اخلاقی با هنجارهای حقوقی، به اتّکاء قوه قاهره قدرت سیاسی موضوعیت پیدا می&shy;کند. بنابراین لازم است که در برنامه&shy; ریزی&shy; های کلان آموزشی به این مهم توجه گردد و موانع عدم توسعه حقوق عمومی از بعد آموزشی برداشته شود. هدف ما در این مقاله شناسایی موانع توسعه حقوق عمومی و ارائه راهکارهایی در این خصـوص می&shy; باشد.<strong><span style="letter-spacing:-.1pt;"><span style="font-size:11.0pt;"></span></span></strong><br> <strong><span style="letter-spacing:-.1pt;">مواد و روش‌ها:</span></strong> <span style="letter-spacing:-.1pt;">این مقاله توصیفی تحلیلی، و با بهره&shy; گیری از روش اسنادی و استفاده از ابزار فیش &shy;برداری تهیه و تدوین گردیده است.</span><strong><span style="letter-spacing:-.1pt;"><span style="font-size:11.0pt;"></span></span></strong><br> <strong><span style="letter-spacing:-.2pt;">یافته‌ها: </span></strong>یافته &shy;های علمی حاکی از آن است که مسیر تغییرات پایدار اجتماعی از مسیر &laquo;آموزش&raquo; نیروی انسانی است، چنان که کشورهای توسعه &shy;یافته نیز &laquo;آموزش&raquo; را مهم&shy;ترین اقدام ملی در مسیر توسعه&shy; یافتگی قلمداد کرده &shy;اند. از این روی به باور نگارنده، توسعه حقوق عمومی نیز در گرو ارتقای سطح آموزش حقوق عمومی بوده و بین آموزش و توسعه حقوق عمومی رابطه معناداری وجود دارد.<span dir="LTR"><span style="font-size:11.0pt;"></span></span><br> <strong><span style="letter-spacing:-.1pt;">ملاحظات اخلاقی:</span></strong> از ابتدا تا انتهای مقاله با پایبندی به اصول صداقت و امانت&shy;داری تهیه و تدوین گردیده است.<br> <strong><span dir="RTL" style="letter-spacing:-.1pt;">نتیجه‌گیری:</span></strong> <span dir="RTL">از جمله نتایج این پژوهش اجمالاً می&shy;توان به وجود آسیب&shy; های متعدد در برنامه&shy; ریزی آموزش حقوق عمومی در مراکز آموزش عالی ایران و ضرورت بازنگری و اصلاح سازوکارهای ناظر بر آن از یک سو و اصلاح فرهنگ بومی و تولید نظریات بومی-تاریخی در راستای توسعه حقوق عمومی در ایران، از سوی دیگر اشاره کرد.</span></span></span></div> <div style="text-align: justify;"><strong>Background and Aim:</strong> The basis of law should be sought in public law. Because basically &quot;legal system&quot; and any &quot;legal order&quot; have meaning in the field of political authority, and the concept of &quot;guarantee of implementation&quot; as a boundary between moral norms and legal norms, relies on the Cairo power of political power. As a result, wherever traces of political power are found, that area must be defined as the realm of public law. Unfortunately, there are obstacles in the development of public law, which in this article has tried to address this issue by emphasizing educational barriers. Our goal in this article is to identify obstacles to the development of public law and provide solutions in this regard<strong><span dir="RTL">.</span></strong><br> <strong>Materials and Methods:</strong> This descriptive-analytical article has been prepared by using documentary method and filing tool.<br> <strong>Results:</strong> Scientific findings indicate that the path of sustainable social change is through the &quot;education&quot; of human resources, as developed countries have considered &quot;education&quot; as the most important national action on the path of development. Therefore, according to the author, the development of public law also depends on improving the level of public law education and there is a significant relationship between education and development of public law.<br> <strong>Ethical considerations:</strong> From the beginning to the end of the article, it has been prepared and compiled with adherence to the principles of honesty and trustworthiness.<br> <strong>Conclusion</strong>: Among the results of this study, we can briefly point to the existence of numerous harms in the planning of public law education in Iranian higher education centers and the need to review and reform the mechanisms governing it on the one hand and reform local culture and produce local-historical theories.
