fa رفع تعارض پیوستن به گروه ویژه اقدام مالی (FATF) با تأکید بر قاعده نفی سلطه و رفع محدودیت‌های سرمایه‌گذاری خارجی Resolving the Conflict of Joining the Financial Action Task Force (FATF) by Emphasizing the Rule of Denial of Dominance and Removing Restrictions on Foreign Investment پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: بر اساس رویه معمول تجارت جهانی، کلیه قراردادهای سرمایه‌گذاری مستقیم خارجی باید از مجرای گروه ویژه اقدام مالی (FATF) عبور کرده و تحت نظارت این نهاد بین‌المللی قرار گیرد، اما در ایران، مخالفان پیوستن به FATF بر این باور هستند که عضویت ایران در تعارض با اصول سیاست خارجی کشور است. بر همین اساس پژوهش حاضر درصدد است تا به این پرسش پاسخ داده می‌شود که در جهت توسعه سرمایه‌گذاری خارجی چگونه می‌توان تعارض موجود میان لزوم پیوستن به FATF و قاعده نفی سلطه را حل نمود؟ مواد و روش‌ها: در مقاله حاضر از روش توصیفی ـ تحلیلی برای بررسی موضوع استفاده شده است. مطالب بحث از طریق مراجعه و گردآوری مطالب به شیوه اسنادی و کتابخانه‌ای انجام شده است. یافته‌ها: راهکار رفع تعارض پیوستن ایران به FATF، استمداد از قواعد فقهی نظیر: مصلحت، اهم و مهم است که با حفظ قائده نفی سلطه، نسبت به حل مشکلات داخلی و خارجی برای توسعه روابط با سایر کشورها، جذب سرمایه، قوی‌شدن کشور برای مقابله با تهدیدات دشمن و همچنین استفاده از ابزارهای مالی برای تعامل با کشورهای دوست و همسو با سیاست خارجی مستقل در جهان قابل تحقق است. انزوای منطقه‌ای و بین‌المللی و عدم پیوستن به این نهاد بین‌المللی هم مشکلات داخلی و بین‌المللی را گسترده‌تر کرده و هم زمینه‌ساز طرح اتهامات واهی علیه ایران می‌شود. ملاحظات اخلاقی: مراحل مختلف پژوهش با در نظرداشتن ملاحظات اخلاقی از جمله رعایت اصل ارجاع‌دهی، استفاده صحیح و علمی از منابع مرتبط و اصل امانتداری انجام شده است. نتیجه‌گیری: بهره‌گیری از قاعده مصلحت و اهم و مهم از سوی رهبر جمهوری اسلامی و موظف‌دانستن نهادهای داخلی، از جمله مجمع تشخیص مصلحت نظام برای حل تعارض پیوستن به FATF و رفع محدودیت‌های سرمایه‌گذاری خارجی نیازمند غیر سیاسی‌کردن پیوستن ایران به FATF است. اقدام بعدی تلاش برای خروج از لیست سیاه FATF و درک این  مسأله است که انزوای بین‌المللی، مانعی برای جذب سرمایه‌های خارجی و مخدوش‌شدن زندگی شهروندان است که در فقه و گفتمان اسلامی پذیرفته نیست، همچنانکه تعامل و ارتباط مالی با کشورهای جهان هم در مسألهFATF و هم در سایر مسائل به معنای پیگیری عزتمندانه مطالبات و حقوق مردم تلقی شود.</div> <div style="text-align: justify;">Background and Aim: According to the normal practice of world trade, all foreign direct investment contracts must pass through the Financial Action Task Force (FATF) and be supervised by this international body. But in Iran, opponents of joining the FATF believe that Iran's membership is in conflict with the principles of the country's foreign policy. Accordingly, the present study seeks to answer the question of how to resolve the conflict between the need to join the FATF and the rule of negation in order to develop foreign investment. Materials and Methods: In this article, a descriptive-analytical method has been used to investigate the issue. The content of the discussion has been done by referring and collecting the materials in a documentary and library way. Results: The solution to the conflict of Iran's accession to the FATF is to use jurisprudential rules such as: expediency, it is important to maintain the rule of denial of domination, to solve internal and external problems to develop relations with other countries, attract capital, become stronger The country is achievable to counter the enemy threats as well as to use financial instruments to interact with friendly countries and in line with independent foreign policy in the world. Regional and international isolation and non-accession to this international body both exacerbate domestic and international problems and pave the way for false accusations against Iran. Ethical considerations: The various stages of the research have been carried out by considering ethical considerations such as observing the principle of referral, correct and scientific use of relevant resources and the principle of fiduciary duty. Conclusion: Utilizing the rule of expediency and the importance of the Supreme Leader of the Islamic Republic and obliging domestic institutions, including the Expediency Council to resolve the conflict of joining the FATF and removing restrictions on foreign investment need to politicize Iran's accession to Is the FATF. The next step is to try to get off the FATF blacklist and understand that international isolation is an obstacle to attracting foreign investment and distorting the lives of citizens, which is not accepted in Islamic jurisprudence and discourse. Also, financial interaction and relations with the countries of the world, both in the FATF issue and in other issues, should be considered as a dignified pursuit of the demands and rights of the people.
