fa ضمانت اجرای نقض موازین حقوق بشری مرتبط با متهم در حقوق کیفری ایران Guaranteeing the Implementation of Human Rights Violations Related to the Accused in Iranian Criminal Law پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: ضمانت کیفری موازین حقوق بشری مهم از موضوعات مهم و محل بحث و نظر است. در این مقاله تلاش شده به بررسی این مهم پرداخته شود که قانونگذار، چه ضمانت اجرایی برای صیانت و حمایت از این حقوق پیش‌بینی کرده است. مواد و روش‌ها: مقاله مورد اشاره توصیفی ـ تحلیلی بوده و با استفاده از روش کتابخانه‌ای به بررسی موضوع مورد اشاره پرداخته و جمع‌آوری داده‌ها، با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافته‌ها: یافته‌های تحقیق بیانگر این امر است که در حقوق کیفری ایران ضمانت اجرای برخی موازین حقوق بشری مرتبط با متهم مانند نقض منع شکنجه، نقض ترک فعل و دستورات مقام قضایی، نقض حقوق اشخاص تحت نظر، نقض قرارهای تأمین کیفری، نقض استقلال و بی‌طرفی بازپرس و قاضی و نقض حریم خصوصی مجازات‌های حبس، انفصال و محرومیت از خدمت تعیین شده است، اما خلأهایی نیز مانند فقدان ضمانت اجرا برای برخی حقوق مانند حق دسترسی به وکیل نیز وجود دارد که زمینه تضییع حقوق متهم را فراهم می‌کند. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. نتیجه‌گیری: موازین حقوق بشری مرتبط با حقوق متهم بسیار آسیب‌پذیر است، لذا لازم است حقوق شهروندی از ضمانت اجراهای لازم کیفری برخوردار بوده و در مواردی مانند حق دسترسی به وکیل نیز ضمانت اجرای مناسب تدوین شود.</div> <div style="text-align: justify;">Background and Aim: Criminal guarantee of human rights standards is an important issue and a point of discussion. This article seeks to examine the fact that the legislature has provided an executive guarantee for the protection and protection of these rights. Materials and Methods: The article is descriptive-analytical and uses the library method to study the subject and data collection has been done by referring to documents, books and articles. Results: The findings of the study indicate that in Iranian criminal law, the guarantee of implementation of some human rights standards related to the accused, such as violation of the prohibition of torture, violation of acts and orders of the judicial authority, violation of the rights of detainees, violation of criminal security agreements, violation of independence and Impartiality of the investigator and the judge and violation of privacy are punishable by imprisonment, dismissal and deprivation of service. But there are also gaps, such as the lack of enforcement guarantees for some rights, such as the right of access to a lawyer, which allow the accused to be deprived of his rights. Ethical considerations: In all stages of writing the present study, while respecting the originality of the texts, honesty and trustworthiness have been observed. Conclusion: It is necessary for citizenship rights to have the necessary criminal enforcement guarantees and in cases such as the right of access to a lawyer; a proper enforcement guarantee should be developed.
