fa بررسی حق تصویر بیماران در حقوق موضوعه ایران و میزان رعایت آن در انتشار تصاویر بیماران کووید-19 در اخبار رسانه ملی (مطالعه موردی بخش خبری 14 شبکه یک سیما) پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA" style="line-height:115%">زمینه و هدف:</span></b><span lang="FA" style="line-height:115%"> با گسترش ارتباطات سلامت، توجه به حق تصویر بیماران در اطلاع‌رسانی‌های رسانه‌ای، اهمیت ویژه‌ای پیدا کرد. مقاله حاضر با هدف بررسی حقوقی تصویر بیماران در حقوق موضوعه کشور و اسناد پزشکی و میزان رعایت این حق در خبر 14 شبکه 1 رسانه ملی انجام شده است</span><span lang="AR-SA" style="line-height:115%">.</span><span lang="FA" style="line-height:115%"><span style="font-family:"B Nazanin""></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA" style="line-height:115%">روش:</span></b> <span lang="AR-SA" style="line-height:115%">در </span><span lang="FA" style="line-height:115%">پژوهش حاضر در گام اول با </span><span lang="AR-SA" style="line-height:115%">روش توصیفی ـ تحلیلی و به صورت کتابخانه‌ای و با مراجعه به اسناد، کتب و مقالات صورت گرفته است و در گام دوم </span><span lang="FA" style="line-height:115%">به روش </span><span lang="AR-SA" style="line-height:115%">تحلیل محتوای کمی و با جمع‌آوری داده‌ها از طریق کدگذاری متون تصویری، میزان نقض حق تصویر را در خبر 14 شبکه یک سیما بررسی شده است.</span><b> </b><b><span lang="FA" style="line-height:115%"><span style="color:maroon"></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA" style="line-height:115%">ملاحظات اخلاقی:</span></b> <span lang="AR-SA" style="line-height:115%">در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.</span><b><span dir="LTR"><span style="line-height:115%"><span style="color:maroon"></span></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA" style="line-height:115%">یافته‌ها:</span></b><span lang="FA" style="line-height:115%"> با اینکه حق تصویر بیماران در حقوق موضوعه کشور و اسناد پزشکی به رسمیت شناخته شده و برای آن ضمانت‌های اجرایی تعریف شده، اما بر اساس نتایج حاصله از آزمون </span><span dir="LTR"><span style="line-height:115%">T</span></span><span lang="FA" style="line-height:115%">، </span><span lang="AR-SA" style="line-height:115%">میانگین رعایت حق تصویر بیماران کووید-19 در بخش خبری 14 با سطح معناداری (002/0=</span><span dir="LTR"><span style="line-height:115%">sig</span></span><span lang="AR-SA" style="line-height:115%">) از سطح آزمون (05/0) کمتر است. بنابراین عدم رعایت حق تصویر بیماران کووید-19 در </span><span lang="FA" style="line-height:115%">ب</span><span lang="AR-SA" style="line-height:115%">خش خبری 14 اثبات شد<span style="text-transform:uppercase">.</span></span><span lang="FA" style="line-height:115%"><span style="color:black"></span></span></span></span></span><br> <b><span dir="RTL" lang="FA"><span style="line-height:107%">نتیجه‌گیری:</span></span></b><span dir="RTL" lang="FA"><span style="line-height:107%"> بر اساس حقوق موضوعه کشور تصویربرداری از بیماران در بیمارستان‌ها و انتشار آن، باید با اجازه بیمار و رییس بیمارستان باشد و نقض این حق، منجر به مسئولیت انتظامی، کیفری و مدنی خواهد شد. از طرفی بررسی بخش خبری 14 شبکه 1 نشان داد در مجموع یک سال پخش اخبار مرتبط با کرونا، در تصاویر اینسرتی، 45 درصد و در مصاحبه‌های خبری، 38 درصد، حق تصویر بیماران در این بخش خبری نقض شده است</span></span><span dir="RTL" lang="AR-SA"><span style="line-height:107%">.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:14px;"><span style="line-height:115%"><span calibri="" style="font-family:"><b><span new="" roman="" style="font-family:" times="">Background and Aim:</span></b><span new="" roman="" style="font-family:" times=""> With the outbreak of Covid-19 disease and the spread of health communication, attention to the image rights of patients in media information became particularly important. This right has been exercised in the news of 14 channels of 1 national media</span><span new="" roman="" style="font-family:" times="">.</span><span style="font-family:"Times New Roman","serif""></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="background:#f2f2f2"><span new="" roman="" style="font-family:" times="">Method:</span></span></b> <span new="" roman="" style="font-family:" times="">In the present study, in the first step, it has been done by descriptive-analytical method and in a library by referring to documents, books and articles, and in the second step by quantitative content analysis method and by collecting data through coding texts. Video, the extent of violation of the image right has been investigated in the news of 14 channels of One TV.</span><span style="font-family:"Times New Roman","serif"" lang="EN"></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span lang="EN" style="background:#f2f2f2"><span new="" roman="" style="font-family:" times="">Ethical Considerations:</span></span></b> <span new="" roman="" style="font-family:" times="">In all stages of writing the present study, while respecting the originality of the texts, honesty and trustworthiness have been observed.</span></span></span><br> <span style="background:#f2f2f2"><span style="line-height:115%"><b><span new="" roman="" style="font-family:" times="">Results<span style="background:#f2f2f2">:</span></span></b><b> </b><span new="" roman="" style="font-family:" times="">Although patients &#39;image rights are recognized in the law of the country and medical documents and executive guarantees are defined for it, but based on the results of T-test, the average observance of patients&#39; image rights in Quid-19 in news section 14 with a significant level ( Sig = 0.002) is less than the test level (0.05).</span></span></span><br> <b><span style="line-height:107%"><span new="" roman="" style="font-family:" times="">Conclusion:</span></span> </b><span style="line-height:107%"><span new="" roman="" style="font-family:" times="">According to the law of the country, filming of patients in hospitals and its publication must be with the permission of the patient and the head of the hospital and violation of this right will lead to disciplinary, criminal and civil liability.
