fa حقوق کودکان در عملیات انتحاری: مطالعه موردی بوکوحرام The Children Rights in the Arrangement of Suicide Operations Case Study: Boko Haram پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: در جهان امروز و در شرایطی که لزوم تحقق ارزش‌های انسانی بیش از پیش در جامعه بین‌المللی احساس می‌شود، کودکان می‌بایست از جمیع حقوق بشری خود و یک زندگی سالم و رو به رشد برخوردار باشند. با وجود این روند سوءاستفاده از کودکان به ویژه در قالب فعالیت‌های تروریستی و عملیات انتحاری همچنان آهنگی رو به رشد دارد. جامعه بین‌المللی همراه با سیر تحولات مربوط به تحقق جمیع حق‌های بشری و در قالب اسناد بین‌المللی متعدد در تلاش بوده است تا در راستای صیانت از کودکان گام‌های ارزشمند و تعیین‌کننده را بردارد. هدف این مقاله با بهره‌گیری از منابع کتابخانه‌ای، اینترنتی و اسناد بین‌المللی، بررسی حقوق کودکان و چگونگی برقراری حمایت‌های مؤثر از آن‌ها در مواجهه با بحران تروریسم و آثار و پیامدهای عملیات انتحاری بر سلامت جسمی و روانی کودک در گستره حقوق بین‌الملل می‌باشد. روش: این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی می‌باشد و روش جمع آوری اطلاعات به صورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: دولت‌ها، سازمان‌های بین‌المللی و نهادهای بین‌المللی و همچنین گروه‌های غیر دولتی حقوق بشری در کشورهای توسعه‌یافته و مدرن می‌بایست کمک کنند تا جریان حقوق بشری جدیدی در حمایت از اقشار ضعیف‌تر مثل کودکان، زنان و... ایجاد شود. در نهایت باید پذیرفت که اگرچه دلایل فعالان حقوق بشر و طرفداران توسعه هنجاری در خصوص حقوق کودک سرباز قابل تأمل است، اما عدم پیشرفت تلاش‌ها در این حوزه را می‌توان به این دلیل دانست که اولاً افکار عمومی جهانی هنوز به طور گسترده‌ای متوجه مسأله کودک سرباز نشده است. تجربه نشان می‌دهد جامعه بین‌المللی به طور کلی و دولت‌ها به طور خاص، زمانی که مسأله‌ای به حد بحران برسد و یا فشار افکار عمومی و جامعه مدنی بسیار زیاد باشد، نسبت به توسعه هنجاری در حقوق بین‌الملل اقدام می‌ورزند. نتیجه‌گیری: استفاده بوکوحرام از کودکان در مناطق مختلف باعث شده که پیامدهای اخلاقی و جسمی و روانی برای کودکان به وجود بیاید. شدت جنایاتی که توسط این گروه صورت گرفته شده است، بیشتر از جنایاتی است که در گذشته توسط گروه‌های تروریستی و شورشی اتفاق افتاده است. اسناد بین‌المللی موجود در خصوص حمایت از کودکان مفید هستند، اما این اسناد دارای ضمانت اجرایی قوی و مؤثر نیستند، برای رفع این نقص دولت‌ها به عنوان تابعان فعال حقوق بین‌الملل باید با یکدیگر، همکاری و همبستگی کامل داشته باشند و در این زمینه اقداماتی را انجام بدهند.</div> <div style="text-align: justify;">Background and Aim: In Today’s world, at this very time when the need to realize human values is felt as never before in the international community, children should make the most of the totality of their human rights and a healthy and growing life. Despite the trend, abusing children, particularly in the form of terrorist activities and suicide operations, continues to gather pace. With the track of developments pertaining to the realization of the totality of human rights, the international community has endeavored in the form of various international documents to take invaluable and decisive steps in protecting children. Method: This Research is of Theoretical Type and the Research Method is Descriptive-Analytical and the Method of Data Collection is Library and has Been Done by Referring to Documents, Books and Articles. Ethical Considerations: In Order to Organize this Research, while Observing the Authenticity of the Texts, Honesty and Fidelity Have Been Observed. Results: The states, international organizations and institutions and non-governmental human-right advocacy groups in modern, developed countries must help launch a novel human-rights movement to protect the disadvantaged strata, such as children and women. Finally, despite the arguments of human-rights activists and advocates of normative development in defense of the child soldiers' rights being noteworthy, the lack of meaningful improvements on this front may be because global public opinion is still not in tune with the problem of child soldiers. Experience suggests that when an issue reaches a critical level or the pressure from the public opinion and the civil society becomes overwhelming, the international community, in general and the government in particular, move towards normative development in international law. Drawing on library and online sources and international documents, this article aims to examine the children's rights and discuss how to effectively protect them against the crisis of terrorism and the effects of suicide operations on the physical and mental health of the child in the realm of international law. Conclusion: Boko Haram's use of minors in various regions has caused adverse ethical, physical and psychological consequences for the children. The intensity of the crimes committed by this organization surpasses crimes of terrorist and rebel groups in the past. The available international documents on children help safeguard their rights and well-being, however, these documents lack powerful and effective legal sanctions. To overcome these shortcomings, the states must cooperate and show solidarity as active defenders of human rights and adopt the necessary measuresh.
