fa ضمان پزشک در تحقیقات زیست‌پزشکی از منظر فقه امامیه پژوهشي Original Article <div style="text-align: justify;"><span style="font-family:Tahoma;"><span style="font-size:12px;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">زمینه و هدف:</span></span></b> <span lang="AR-SA"><span style="line-height:115%">از مباحث مهم کنونی در عرصه علوم پزشکی، تعیین چارچوب اخلاقی، شرعی و حقوقی پژوهش‌هایی است که برای توسعه این علوم بر روی آزمودنی انسانی صورت می‌گیرد.</span></span><span lang="AR-SA"><span style="line-height:115%"> در این مقاله با نقد و بررسی ادله ضمان و عدم ضمان پزشکان در پژوهش‌های زیست‌پزشکی سعی شده تا دیدگاه فقه اسلامی در این زمینه تبیین شود.<span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">روش:</span></span></b> <span lang="AR-SA"><span style="line-height:115%">این تحقیق از نوع نظری بوده، ‌روش تحقیق به صورت توصیفی ـ تحلیلی می&rlm;باشد و روش جمع&rlm;آوری اطلاعات به صورت کتابخانه&rlm;ای و اینترنتی است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.<span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">ملاحظات اخلاقی:</span></span></b> <span lang="AR-SA"><span style="line-height:115%">در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.<span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">یافته‌ها:</span></span></b> <span lang="AR-SA"><span style="line-height:115%">نظریه عدم ضمان پزشک که توسط فقهای معاصر و قانون جدید مجازات اسلامی پذیرفته شده است، تنها شامل تحقیقات درمانی و سایر اقدامات درمانی استاندارد می‌شود و نمی‌توان حکم آن را به تحقیقات غیر درمانی سرایت داد.</span></span><b><span lang="FA"><span style="line-height:115%"><span style="font-family:"B Nazanin""></span></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%">نتیجه‌گیری:</span></span></b> <span lang="AR-SA"><span style="line-height:115%">بر اساس مباحث صورت‌گرفته روشن است که بر اساس مبانی فقهی حکم به عدم ضمان پزشک در تحقیقات درمانی صحیح‌تر به نظر می‌رسد. در عین حال با توجه به عدم کاربرد مبانی عدم ضمان در خصوص تحقیقات غیر درمانی و با استناد به قواعد اتلاف و تسبیب و لاضرر، حکم به ضمان پزشک در این‌گونه تحقیقات به حقیقت نزدیک‌تر است.<span style="font-family:"B Nazanin""></span></span></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:14px;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Background and Aim:</span></span></b> <span lang="EN"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">One the most important issues in the field of medical sciences are the ethical, legal and religious framework of researches that is done on human subject for development of science. In this paper we review the reasons of liability and non-liability of physician in biomedical research to explain the view of Islamic law in this matter</span></span></span><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">.</span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Method:</span></span></b> <span style="line-height:115%"><span new="" roman="" style="font-family:" times="">This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and internet sources and has been done by referring to documents, books and articles.</span></span><span lang="EN"><span style="line-height:115%"><span style="font-family:"Times New Roman","serif""></span></span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span lang="EN"><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Ethical Considerations:</span></span></span></b> <span style="line-height:115%"><span new="" roman="" style="font-family:" times="">In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.</span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Results: </span></span></b><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">The theory of non- liability of the physician, which is accepted by contemporary jurists and the Islamic Penal Code, only includes Therapeutic researches and other standard medical measures, and its ruling cannot be extended to non-therapeutic researches.</span></span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Conclusion:</span></span></b><b> </b><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Based on discussions made in this paper is clear that based on Islamic jurisprudence, the theory of non-liability of physician in Therapeutic research seems to be more accurate but given that the reasoning for lack of liability does not apply to the scientific and non-therapeutic researches, so according to Islamic rules, the liability theory in scientific research is closer to the truth.</span></span><span dir="RTL" lang="AR-SA"><span style="line-height:115%"><span style="font-family:"Times New Roman","serif""></span></span></span></span></span><br> <span style="line-height:115%"><span calibri="" style="font-family:"><b><span style="line-height:115%"><span new="" roman="" style="font-family:" times="">Please cite this article as:</span></span></b></span></span><br> <span style="line-height:107%"><span new="" roman="" style="font-family:" times="">Rahmani Manshadi H.
