fa مفهوم‌شناسی تحقق مترقی حق بر غذا: حد فاصل امنیت غذایی و حاکمیت غذایی Conceptology of Progressive Realization of the Right to Food the Contour between Food Security and Food Sovereignty پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: حقوق بین‌الملل همانند دیگر شاخه‌های حقوق از خلأ ناشی نمی‌شود و لزوماً هم به صورت پرسر و صدا در عالم حقوق چهره‌نمایی نمی‌کند، بلکه اغلب در نتیجه توسعه‌ نامحسوس ارزش‌های یک جامعه در اثر ایده‌های جدید و ریشه‌دار، هویدا شده و به ارزش‌هایی بدل می‌شود که پیش‌نیاز رشد آگاهی اجتماعی هستند تا بدانجا که اعتقادی غیر قابل نقض قائم بر تأیید مشروعیت و قانونیت آن ایجاد می‌شود، بدین‌ترتیب عناصر «پیش‌هنجاری» حقوق بین‌الملل، مانند تفسیر بازیگران غیر دولتی و غیر قضایی برجسته، از جمله اسناد حقوق نرم، حتی اگر هنجارهای لازم‌الاجرا تشکیل نداده باشند، تا بدانجا کارایی دارند که بتوان آن‌ها را عملاً در محدوده حق بر غذا به وضوح شاهد بود. نقش بازیگران مختلف در بسط اطلاعات مربوط به حق بر غذا به منظور جلب حمایت برای این دست از حقوق و همچنین تقویت این حق در گفتمان اصلی و حقوق بشر پررنگ است. این اثرگذاری را به وضوح می‌توان در توسعه‌ دامنه مفهوم حق بر غذا به منظور تحقق مترقی این حق با اعمال تئوری تغییر و هرچه دموکراتیزه‌‌کردن تحقق این حق بشری از ابتدای طرح مفهوم تاکنون در عرصه حقوق و سیاست دید. چنین گذاری عمدتاً از رهگذر مفهوم پذیرفته‌شده امنیت غذایی به مفهوم رادیکال حاکمیت غذایی با محوریت تحقق مترقی حق بر غذا رخ داده است. روش: این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی است و روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در تحقیق حاضر، اصل امانتداری، صداقت، بی‌طرفی و اصالت اثر رعایت شده است. یافته‌ها: تحقق حق بر غذا نیازمند اتخاذ رویکرد پایداری در تولید و توزیع است، این امر زمانی محقق می‌شود که برخلاف قواعد وضع‌شده پیشین، با ابتنای بر تئوری تغییر، رویکرد از پایین به بالا، جایگزین رویکرد غالب از بالا به پایین در تصمیم‌سازی و تصمیم‌گیری شود. نتیجه‌گیری: به منظور هرچه دموکراتیزه‌کردن تحقق حق بشری بر غذا و دسترسی بشر به غذای سالم و پایدار، گذار از رویکرد امنیت غذایی به سمت حاکمیت غذایی که تصمیم‌سازی و تصمیم‌گیری از مزرعه تا سفره را به دست اصلی‌ترین گروداران (مصرف‌کنندگان) می‌سپارد، ضروری می‌نماید.</div> <div style="text-align: justify;">Background and Aim: International law, like other branches of law, does not emerge from a vacuum and does not necessarily appear loudly in the world of law. Rather, it is often revealed as a result of the imperceptible development of the values of a society as a result of new and deep-rooted ideas and turns into values that are a prerequisite for the development of social awareness; Until an inviolable belief based on confirming its legitimacy and legality is created. In this way, the "pre-normative" elements of international law, such as the interpretation of prominent non-state and non-judicial actors, including soft law documents, even if they do not constitute enforceable norms, are effective to the extent that they can be clearly witnessed in practice within the scope of the right to food. The role of different actors in expanding the information about the right to food to gain support for this kind of right and to strengthen this right in the main discourse and human rights is bold. This influence can be clearly seen in the development of the scope of the concept of the right to food to realize the progressive realization of this right by applying the theory of change and democratizing the realization of the human right to food. Methods: This research is of a theoretical type and the research method is descriptive and analytical and the method of collecting information is library and it was done by referring to documents, books and articles. Ethical Considerations: In this research, the principles of trustworthiness, honesty, neutrality and originality of the work have been observed. Results: The realization of the right to food requires the adoption of a sustainable approach in production and distribution; this is achieved when, contrary to the previously established rules, based on the theory of change, a bottom-up approach replaces the dominant top-down approach in decision-making. Conclusion: To further democratize the realization of the human right to food and human access to healthy and sustainable food, it is necessary to transition from the approach of food security to food governance, which leaves decision-making from farm to fork in the hands of the main stakeholders (consumers).
