fa آسیب‌شناسی حقوقی رسیدگی به پرونده‌های قاچاق فرآورده‌های نفتی در پرتو حق بر دادخواهی Legal Pathology of Dealing with Cases of Petroleum Products Smuggling in the Light of the Right to Litigation پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: نفت و فرآورده‌های نفتی، مهم‌ترین منبع مالی و محور چرخش اقتصادی کشورمان است. از این رو در قوانین و مقررات کنونی، سازوکار سخت‌گیرانه‌ای جهت برخورد با هرگونه عرضه، فروش و صادرات فراورده‌های نفتی یارانه‌ای از سهمیه داخل کشور پیش‌بینی شده است، اگرچه این امر در راستای حفظ منافع عمومی بسیار حائز اهمیت است، اما لازم است که سازوکارهای حمایتی ویژه‌ای نیز برای تضمین حقوق فردی افرادِ در مظان اتهام این‌گونه جرائم به منظور دفاع مناسب از حقوق خود و بهره‌مندی از نظام دادرسی منصفانه توسط قانونگذار در نظر گرفته شده باشند. این در حالی است که وضعیت کنونی دادرسی پرونده‌های قاچاق فرآورده‌های نفتی از حیث هنجاری و رویه‌ای عملکردی، نقاط ضعف، کاستی‌ها و اشکالات متعددی دارد که به حق بر دادخواهی متهم در این رابطه صدمات به سزایی وارد می‌آورد، لذا مقاله حاضر درصدد پاسخ به این سؤال مهم برمی‌آید که چه آسیب‌های حقوقی در این نظام دادرسی تخصصی وجود داشته و چه راهکارهایی برای اصلاح و ترمیم آن‌ها می‌توان پیشنهاد نمود؟ روش: این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی ـ تحلیلی می‌باشد و روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقاالت صورت گرفته است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: در نظم حقوقی کنونی کشورمان، دادرسی پرونده‌های قاچاق فرآورده‌های نفتی از فرآیند خاصی تبعیت می‌کند که رسیدگی اداری، دادرسی کیفری، رسیدگی شبه‌کیفری و دادرسی اداری، ساختار آن را تشکیل می‌دهند و هر یک دارای کاستی‌ها و نقایصی است. نتیجه‌گیری: به طور کلی در مقاله حاضر دریافتیم که لازم است جایگاه کارگروه تعیین ماهیت در حد مرجع کارشناسی حفظ شده و سازوکارهای تحقیق دادرس تعزیرات حکومتی به طریق ارجاع موضوع به کارشناسی کارگروه جایگزین و یا کارشناسی رسمی دادگستری تقویت گردد. همچنین ترکیب شعب ویژه تعزیرات حکومتی تغییر کرده و از میان مقامات قضایی تشکیل شوند، افزون بر این‌ها لازم است شکایات ذی‌نفعان از نظریات اعلامی کارگروه در شعب دیوان عدالت اداری به عنوان سازوکار فرجام‌خواهی قضایی پذیرفته شود.</div> <div style="text-align: justify;">quota. Although this is very important in order to protect the public interest, it is necessary to have special protection mechanisms in laws provided by legislators to guarantee the individual rights of people accused of such crimes in order to properly defend their rights and benefit from a fair trial system. This is despite the fact that the current state of proceedings in cases of petroleum products smuggling has many weaknesses, shortcomings and problems in terms of norms and functional procedures, which rightfully causes significant damage to the prosecution of the accused in this regard. Therefore, this article aims to answer this important question: what legal damages exist in this specialized judicial system and what solutions could be suggested to correct and solve them? Method: This research is theoretical; its method is descriptive and analytical. The method of collecting information is in the form of a library, referring to documents, books and articles. Ethical Considerations: In all stages of writing the present research, while respecting the originality of the texts, honesty and trustworthiness have been observed. Results: In the current legal system of our country, the proceedings of petroleum product smuggling cases follow a special process, which consists of administrative proceedings, criminal proceedings, quasi-criminal proceedings and administrative proceedings, each one with shortcomings and defects. Conclusion: Generally, we found that it is necessary to maintain the position of the "Nature Determination Working Group" as an expert authority and to strengthen the research mechanisms of the government penal judge by referring the matter to the expert of the alternative Working Group or the official expert of the judiciary. We suggested changing the composition of the Tazirat’s special branches in which judicial officials to be member; In addition to these, it is necessary to accept the complaints of the beneficiaries from the opinions of the Working Group in the branches of the Administrative Court of Justice as a judicial appeal mechanism.
