fa بسامد فشار روانی بر کودکان و نوجوانان ناقض قوانین جزایی The Frequency of Psychological Pressure on Children and Teenagers Violating Criminal Laws پژوهشي Original Article <div style="text-align: justify;">زمینه و هدف: فشار روانی در ارتکاب اعمال مجرمانه و نیز در واکنش‌های جزایی نسبت به کودکان و نوجوانان بزه‌کار که خود قربانیان خاموش شرایط و زندگی نابسامانند، چالشی است قابل ملاحظه که به اقتضای وضعیت اجتماعی ملتهب کنونی، پرداختن به آن، تأملی ژرف و ضرورتی مضاعف را می‌طلبد. این مهم، مستلزم پژوهشی بدیع و میان رشته‌ای است که مقاله حاضر، با توجه به مقتضیات زمان و مکان و تفاوت‌های فردی ـ اجتماعی کودکان و نوجوانان بزه‌کار، با هدف وصول به عدالت قضایی یکسان و فراگیر به آن پرداخته است. روش: مقاله حاضر، علاوه بر استفاده از روش توصیفی ـ تحلیلی و گردآوری داده‌ها به شیوه کتابخانه‌ای، از نظرات دکترین و متخصصین مربوطه نیز بهره برده و نتایج آن در قالب نمودار ارائه نموده است، لذا این پژوهش، با روش ترکیبی و کاربست مبانی کمی و کیفی پژوهش (طیف لیکرت) صورت گرفته است. ملاحظات اخلاقی: در روند تألیف این پژوهش، بر ملاحظات اخلاقی پژوهش کتابخانه‌ای از جمله اصالت متون، صداقت و امانتداری اهتمام ورزیده شده است. یافته‌ها: از مهم‌ترین یافته‌های پژوهش حاضر، ارائه مؤلفه «نقش اساسی عوامل فشار روانی در اغلب اقدامات بزه‌کارانه کودکان و نوجوانان ناقض قوانین جزائی» است که در پی طرح کارشناسانه عوامل ایجاد فشار روانی، تحلیل واکنش‌ها و تبیین راهکارهای مدارا، با کاربرد پژوهش کیفی، تحصیل گردید. همچنین بر اساس نظر (&lrm;۸۲ درصد) دکترین حقوقی و متخصصین مربوطه، «فشار روانی کودکان و نوجوانان، مؤثرتر از تربیت نادرست آن‌ها در ارتکاب اعمال مجرمانه می‌باشد.» نتیجه‌گیری: لزوم لحاظ ابعاد گسترده فشار روانی کودکان و نوجوانان ناقض قوانین جزائی در ارتکاب اعمال مجرمانه، اتخاذ راهکارهای پیشگیرانه متناسب با مقتضیات زمان و مکان، را در سیاست جنایی ج.ا.ا می‌طلبد. همچنین جنبه فشار روانی برخی واکنش‌های جزایی قانونی نسبت به اطفال و نوجوانان ناقض قوانین جزایی و عدم کفایت جنبه اصلاح و تربیت آن‌ها، با سنجه مبانی اسلامی ـ تربیتی و اسناد بین‌‌المللی، در مواردی نشانگر فاصله معنادار وضعیت موجود با وضعیت مطلوب است.  </div> <div style="text-align: justify;">Background and Aim: Psychological pressure in committing criminal acts and in punitive reactions towards delinquent children and teenagers, who themselves are silent victims of unstable living conditions, poses a significant challenge that requires deep reflection and urgency in addressing it, given the current social situation. This matter needs a novel interdisciplinary study, which this article aims to do, to achieve equal and vast judicial justice. Method: This article employs a descriptive-analytical approach and gathers data through library research, relying on the opinions of relevant experts and scholars. The results are presented in the form of diagrams. Therefore, this research has been conducted using a combined method, incorporating both quantitative and qualitative (Likert scale) research foundations. Ethical Considerations: Throughout the process of writing this research, ethical considerations of library research, including authenticity, text integrity, honesty, and trustworthiness, have been observed. Results: One of the most significant findings of this study is presenting the "fundamental role of psychological pressure factors in most delinquent actions of children and teenagers, who violate criminal laws". This was achieved through a systematic analysis of the factors that contribute to psychological pressure, the analysis of reactions, and the explanation of coping strategies using qualitative research. According to 82% of legal experts and specialists, "psychological pressure on children and teenagers has a more significant impact on their involvement in criminal activities than their bad upbringing". Conclusion: The need to consider the extensive dimensions of psychological pressure on children and teenagers, who violate criminal laws, in the commission of criminal acts, demands the adoption of preventive measures that are appropriate to the current time and place in Iran’s criminal policy. Furthermore, the aspect of psychological pressure in certain legal punitive reactions towards children and teenagers, who violate criminal laws, and the inadequacy of their correction and upbringing within the framework of Islamic educational principles and international documents, in some cases show a significant distance between the current situation and the desired state.
