fa واکاوی چالش‌های حقوقی و اخلاقی مرتبط با آزمایش‌های ژنتیک پزشکی پژوهشي Original Article <div class="WordSection1" dir="RTL"> <div class="WordSection1" dir="RTL" style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">زمینه و هدف:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">امروزه نتیجه آزمایش‌های ژنتیک پزشکی می‌تواند به عنوان یکی از معتبرترین و کم‌خطاترین دلایل مورد استفاده قرار گیرد و کاهش اشتباهات قضایی را تا حد بسیار زیادی تضمین کند. از سوی دیگر به دلیل پیچیده ‌بودن این علم، نگرانی‌ها و &nbsp;دغدغه‌های حقوقی و اخلاقی مختلفی را به همراه داشته و در مواردی زنگ خطر را به صدا درآورده است. مطالعه چالش‌های حقوقی و اخلاقی موجود در رابطه با آزمایش‌های ژنتیک پزشکی هدف این نوشتار قرار گرفته است</span></span><span lang="AR-SA"><span style="line-height:115%">.</span></span><span lang="FA"><span style="line-height:115%"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">روش: </span></span></span></b><span lang="AR-SA"><span style="line-height:115%">این پژوهش با روش توصیفی ـ تحلیلی به رشته تحریر درآمده است و برای گردآوری اطلاعات نیز از روش مطالعه کتابخانه‌‌ای بهره گرفته شده است.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">ملاحظات اخلاقی:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">در پژوهش حاضر نویسندگان تلاش نموده‌اند صداقت علمی و ارجاعات توأم با اصالت را رعایت نمایند.</span></span><span lang="FA"><span style="line-height:115%"><span style="color:black"></span></span></span></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">یافته‌ها:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">نتایج پژوهش حاکی از آن است که چالش‌هایی همچون جایگاه رضایت افراد در انجام تحقیقات ژنتیکی، دوراهی افشاگری یا عدم افشای اطلاعات در خصوص تحقیقات پس از مرگ افراد، آزمایش‌های ژنتیکی مربوط به کودکان و مسائل ویژه در غربالگری آنان، افشای اطلاعات ژنتیکی به همسران یا عدم افشای آن، استفاده‌های ناروا از داده‌های ژنتیکی، مطالعات ژنتیکی و چالش‌های مربوط به حریم خصوصی شرکت‌کنندگان در این آزمایش‌ها نیازمند توجه و تصویب شیوه‌‌‌نامه‌های مرتبط در وزارت بهداشت و سازمان نظام پزشکی است.</span></span><b><span lang="FA"><span style="line-height:115%"><span style="font-family:&quot;B Nazanin&quot;"></span></span></span></b></span></span></span><br> <span style="line-height:115%"><span style="direction:rtl"><span style="unicode-bidi:embed"><b><span lang="FA"><span style="line-height:115%"><span style="color:maroon">نتیجه‌گیری:</span></span></span></b> <span lang="AR-SA"><span style="line-height:115%">لزوم مطالعه این چالش‌ها از آن جاست که عدم شناخت آن‌ها می‌تواند حقوق، امنیت، آزادی‌های اساسی و کرامت انسانی افراد را به خطر بیاندازد.</span></span></span></span></span></span></span></div> <div style="text-align: justify;"><div aria-label="شکستن صفحه" class="cke_pagebreak" contenteditable="false" data-cke-display-name="pagebreak" data-cke-pagebreak="1" style="page-break-after:always" title="شکستن صفحه"></div></div> </div> <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Background and Aim:</span></span></b> <span style="line-height:115%">Medical genetics results can be used today as one of the most valid and least error-prone reasons which contribute greatly to reduced judicial errors. However, due to its complexity, this science has brought with it many legal and moral concerns and sometimes raising alarms. In this article, we will investigate the ethical and legal challenges related to medical genetic tests. </span><b><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,serif"></span></span></b></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Method:</span></span></b><span style="line-height:115%"> This research has been written with a descriptive-analytical method and the library study method has been used to collect information.</span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span lang="EN"><span style="line-height:115%"><span style="color:maroon">Ethical Considerations:</span></span></span></b> <span style="line-height:115%">In all stages of the current research, the authors have tried to observe scientific honesty and original references.</span></span></span><br> <span style="background:#f7f7f7"><span style="line-height:115%"><b><span style="line-height:115%"><span style="color:maroon">Results:</span></span></b><b> </b><span style="line-height:115%">The results indicate that challenges such as the position of people&#39;s satisfaction in conducting genetic research, the dilemma of disclosing or not disclosing information regarding post-mortem investigations, Genetic testing of children and specific issues in their screening, disclosure or non-disclosure of genetic information to spouses, challenges associated with genetic studies and misuse of genetic data.
